PARTIAL RELEASE OF REAL ESTATE MORTGAGE
KNOWN BY ALL THESE PRESENTS, That The Bank of Commerce, a corporation of
the United States of America, does hereby certify that mortgage bearing the date of June
29, 2007 made and executed by JM Land Development, LLC; Sherry Merritt,
Individually; and Joel Merritt and Sherry Merritt, Husband and Wife, as mortgagor(s) to
The Bank of Commerce as mortgagee(s) conveying certain real estate therein mentioned
as security for the payment of $977,182.00 as therein stated, which mortgage was
recorded in the office of the County Clerk and Ex- Officio Register of Deed of Lincoln
County, State of Wyoming, on September 12, 2007 in Book 672PR, Page 49 mortgaging
the following described real estate in said County, to wit:
A portion of the property, as referred to in the Deed recorded in Book 554, on Page 159,
within the Southwest Quarter of the Northeast Quarter of Section 25, Township 34 North,
Range 119 West, of the 6 P.M., Lincoln County, Wyoming, the metes and bounds being
more particularly described as follows:
BEGINNING at a Point in the North line of the Aullman property, as referred to in the
Deed recorded in Book 577PR, on Page 454, with said Office, said Point of Beginning, being
336.41 feet South 89 °41'07" East, along said North line, from the Paul N. Scherbel RLS 164,
1976 location for the Southeast Corner of the Northwest Quarter of said Section 25;
thence Northeasterly, along a 50.00 feet Radius Curve to the Right, through a central angle
of 27 °03'16 an arc length of 23.61 feet, and a chord of North 28 °03'41" East 23.39
feet;
thence North 41 °35'19" East 80.20 feet to the beginning of a 126.00 feet Radius Curve to the
Left;
thence Northeasterly, along said Curve to the Left, through a central angle of 34 °40'04" an
arc length of 76.24 feet and a chord of North 24 °15'17" East 75.08 feet;
thence North 6 °55'16" East 86.55 feet;
thence North 3 °51'46" East 96.18 feet;
thence North 2 °37'48" East 136.00 feet;
thence South 87 °22'12" East, perpendicular to last line, 600.25 feet to a point in the West
line of the Soest property, as referred to in the Deed recorded in Book 322PR, on Page
48, with said Office;
thence South 2 °30'38" East, along said West line, 443.75 feet to a Point in the said North
line;
thence North 89 °41'07" West, along said North line, 737.30 feet, to the Point of Beginning.
Is, released, and discharged as to the aforementioned premises, and in consideration
thereof the said mortgagee does hereby release and quitclaim unto the said mortgagor the
premises described herein.
It being expressly understood and agreed that this release shall not affect the said
mortgage of the security thereof, in any manner or form whatsoever, as to the remainder
of the real estate mortgaged therein and thereby.
