KNOW ALL MEN BY THESE PRESENTS: Kenneth H. Broughton and Paula McCann,
of the County of Lincoln and State of Wyoming, hereinafter referred to as "Grantor for and in consideration
of ONE DOLLAR ($1.00) and other good and valuable consideration, the receipt of which is hereby
acknowledged, do hereby grant unto the County of Lincoln, State of Wyoming, hereinafter referred to as
"Grantee the right to lay out, construct, inspect, operate and maintain a road for the use of the public over
and across the following described lands situate in the County of Lincoln and State of Wyoming, to -wit:
LEGAL DESCRIPTION
FOR PUBLIC ROAD EASEMENT
TO ENLARGE RIGHT -OF -WAY
FOR ASPEN HILL DRIVE
COUNTY ROAD NO. 12 -166S
An area of land located within the NW1 /4NE1 /4 of Section 22, Township 36 North, Range 119 West,
Lincoln County, Wyoming, and also within and being part of LOT 13 of the ASPEN HILL
SUBDIVISION, of record as Plat No. 10 filed in the Office of the Lincoln County Clerk, with metes and
bounds more specifically described as follows:
BEGINNING at the point of curvature of Curve No. 24 on the easterly boundary of Lot 13,
as depicted on the original said Plat No. 10, said point being the location of a steel T stake
with metal cap inscribed "SURVEY POINT DO NOT DISTURB RLS 164" and bearing
S 29 °34'04" E a distance of 716.60 feet from the North Quarter- Section Corner of said
Section 22; and running
THENCE S 05 °41' 14" W a distance of 64.35 feet to a point marked by a 2.5" diameter
aluminum survey cap at ground level, inscribed "ROSS TURNER SURVEY POINT PE
LS 3514" atop a 5/8" diameter reinforcing bar post;
THENCE S 06 °00'44" W a distance of 77.78 feet to a point of intersection with a curve on
the easterly boundary of Lot 13, said point marked by another 2.5" diameter aluminum
survey cap at ground level, inscribed "ROSS TURNER SURVEY POINT PE LS
3514" atop a 5/8" diameter reinforcing bar post;
THENCE Northerly, along the record easterly boundary of Lot 13, 18.46 feet along a non-
tangent curve to the right, with a radius of 100.00 feet and an initial tangent bearing of N
41°25'19" E, through a central angle of 10 °34'41
THENCE, continuing along said record boundary, N 52 °00'00" E a distance of 0.71 feet;
THENCE, along said record boundary, 42.59 feet along a tangent curve to the left, with a
radius of 40.00 feet, through a central angle of 61 °00'00
THENCE N 09 °00'00" W, along said record boundary, a distance of 91.65 feet to the point
of beginning;
ENCLOSING an area of 1969.53 square feet (0.05 acres), more or less.
hereby releasing and waiving all rights under the homestead laws of the State of Wyoming;
Grantor also grants the right of ingress and egress to and from described 1969.53 square feet of land
for any and all purposes necessary and incidental to the exercise, by the Grantee, and the public, of the rights
granted under this conveyance;
Grantee agrees to maintain culverts of suitable size across such ditches and laterals of Grantor as
necessary for proper operation of irrigation systems and in the case of new construction, the grantee agrees to
construct culverts of suitable size across such ditches and laterals of Grantor as necessary for proper operation
of the irrigation systems.
The easement herein granted shall be perpetual so long as the above described lands are used for the
purpose of a public road.
