This Amendment to Real Estate Purchase Agreement /Contract for Deed made
December 12, 2006, by and between DAYTON RANCHES, INC., Seller, and John L. Brown
and Carma L. Brown, husband and wife, Purchasers referencing a property description already
made part of Amended Notice of Existing Real Estate Agreement dated August 3, 2007.
The existing Real Estate Purchase Agreement/Contract for Deed, paragraph la and b,
read as follows:
a. The balance of the Purchase Price shall accrue interest at the rate of six percent
(6 per annum for the period of five (5) years. Purchasers hereby agree to pay the
Sellers the remaining balance of One Hundred :Pcrty -Nine Thousand Do tars.
($149,000.00) at the rate of Seven Hundred Dollars ($700.00) per month beginning on
the 17` day of January, 2007 and due on the 17 day of each month for the period of
sixty (60) months. Said payments shall be divided so that Five Hundred Dollars
($500.00) shall be applied to the principal amount and Two Hundred Dollars ($200.00)
shall be applied to the interest. Any additional money paid by the Purchasers, not
designated as property tax payment, shall be applied to the principal.
b. In the event that the Purchasers have not defaulted in their obligations under this
Agreement, the Purchasers shall tender to the Seller the amount of One Hundred Fifty
One Thousand Seven Hundred Dollars ($151,700.00) on January 17, 2012. Said
payments shall consist of the remaining principal balance of One Hundred Nineteen
Thousand Dollars ($119,000.00) and remaining unpaid interest balance of Thirty -Two
Thousand Seven Hundred Dollars ($32,700.00). (As amended on July 1, 2010).
WHEREFORE, in consideration of the mutual promises of each of the parties, paragraphs 1 a
and 1 b of the Real Estate Purchase Agreement /Contract for Deed shall be amended to read as
a. The balance of the Purchase Price shall accrue interest at the rate of six
percent (6 per annum for the period of six (6) years. Pnrchasers hereby agree to pay
the Sellers the remaining balance at the rate of One Thousand Dollars ($1,000.00) per
month beginning on the 17 day of June, 2011 and due on the 17` day of each month for
each month until January 17 2013. Said payments shall be divided so that Five
Hundred Dollars ($500.00) shall be applied to the principal amount and Five Hundred
Dollars ($500.00) shall be applied to the interest. Any additional money paid by the
Purchasers, not designated as property tax payment, shall be applied to the principal.
b. In the event that the Purchasers have not defaulted in their obligations under this
Agreement, the Purchasers shall tender to the Seller the amount of One Hundred Forty
Seven Thousand Eight Hundred and Two Dollars Forty -One Cents ($147,802.41) on
January 17, 2013. Said payments shall consist of the remaining principal balance of
