For and in consideration of the sum of Ten Dollars and other good and valuable
consideration in hand paid, receipt of which is hereby acknowledged, William J.
McGinnis III, Trustee of the William J. McGinnis III Revocable Trust dated September 4,
1998, as amended, hereinafter referred to as "Grantor does hereby grant to Fish
Creek Flying W Ranches, Inc., hereinafter referred to as Grantee, a non exclusive
easement and right -of -way to construct, maintain and use a road for the purposes of
ingress and egress and installing above ground and /or underground utilities along a
route on, across, under and through the portion of the following described lands owned
by Grantor, situate in the County of Lincoln, State of Wyoming, to wit:
The real property described in Exhibit "1" attached hereto.
Said grant of easement is subject to the following conditions, exceptions and
reservations:
1. Grantee shall have the right to construct, maintain and repair a roadway for
ingress and egress on and over this easement.
2. Grantee shall have the right to construct, maintain and repair above ground
and /or underground utilities along a route on, across, under and through this easement.
3. This easement shall be for the benefit of, run with and be appurtenant to the
real property or any portion thereof described as:
The real property identified in Exhibit "2" attached hereto;
and shall be a burden on and a covenant which runs with the lands of Grantor identified
above (Exhibit "1") for the benefit of the lands of Grantee identified in this paragraph
(Exhibit "2
4. This is a non exclusive easement. Grantor reserves the right to occupy and
use the Easement Area for all purposes, including but not limited to unimpeded pasture
use, not inconsistent with the rights herein granted.
5. Whenever used, the singular number shall include the plural, the plural the
singular, and the use of gender shall include all genders; the covenants herein
contained shall bind, and the benefits and advantages shall inure to the respective
heirs, successors and assigns, of the parties hereto.
