HomeMy WebLinkAbout959416I STATE OF WYOMING County of Lincoln ESTOPPEL AFFIDAVIT ss 000131 RECEIVED 5/25/2011 at 1:07 PM RECEIVING 959416 BOOK: 767 PAGE: 131 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY I, JOHN HARPER III, a SINGLE MAN, being first duly sworn, depose and say: That I am the identical party who made, executed and delivered that certain Grant Deed in Lieu of Foreclosure to KRIS H. WRIGHT, dated the 31st day of August, 2010. LOT THIRTEEN (13) AND LOT FOURTEEN (14) of the EIDEN ADDITION TO THE TOWN OF LABARGE, LINCOLN COUNTY, WYOMING AS DESCRIBED ON THE OFFICIAL PLAT OF THE SCHMID ADDITION AND EIDEN ADDITION TO THE TOWN OF LABARGE, LINCOLN COUNTY, WYOMING, RECORDED JULY 6, 1993 AS MAP NUMBER 276 -A AND DOCUMENT NUMBER 767481, IN THE OFFICE OF THE CLERK, LINCOLN COUNTY, WYOMING. That the aforesaid Deed was an absolute conveyance of the title to said real property to KRIS H. WRIGHT in effect as well as in form, and was not, and is not now, intended as a Deed of Trust, Mortgage or security of any kind, and that possession of said real property has been surrendered to the said KRIS H. WRIGHT; That the consideration in said Deed was and is the full cancellation of all debts, obligations, costs and charges heretofore existing on the property therein and hereinbefore, described in the Deed of Trust executed by and between JOHN HARPER III, a single man, as Grantor in Deed of Trust, and KRIS H. WRIGHT, a married man, dealing with his sole and separate property, as Beneficiary. That the aforesaid Deed and conveyance was made by me as the result of my request; that KRIS H. WRIGHT accepts said Deed and that it was my free and voluntary act; that at the time of making said Deed, I felt and still feel that the Mortgage indebtedness above mentioned represented a fair value of the property so deeded; that the said Deed was not given as a preference against any other of my creditors, that at the time it was given there was no other person or persons, firms or corporations other than the Grantee therein named interested either directly or indirectly in said real property, except as disclosed in said Deed; that I am solvent and have no other creditors whose rights would be prejudiced by such conveyance, and that I am not obligated upon any bond or other Mortgage or Deed of Trust whereby any lien has been created or exists against the said property, except as disclosed by said Deed; and that in offering the same, I am not acting under any misapprehension as to the effect thereof, nor under any duress, undue influence or misrepresentation by the Grantee or the agent or Attorney of the Grantee in said Deed, and that it was my intention as Grantor to convey, and by said Deed did convey to KRIS H. WRIGHT all my right, title and interest absolutely in and to the real property described in said Deed. This Affidavit is made for the protection and benefit of the aforesaid Grantee in said Deed, its successors and assigns, and all other parties hereafter dealing with, insuring same, or who may acquire an interest in the property described therein, and shall bind the respective heirs, successors, executors, administrators and assigns of the undersigned.
