That he is now, and was at all times herein mentioned, the duly elected, qualified, and acting Sheriff of Lincoln County, Wyoming 2. That on the 25 day ofJanuary, 2011, at 10:00 o'clock A.M., at the front door of the Courthouse of the County of Lincoln, State of Wyoming, in Kemmerer, Wyoming, the same being also the place of holding the District Court in said County, and at public venue, to the highest bidder for cash, he offered for sale the following- described land and premises as separate parcels, then offered the following described lands as a whole, and then sold said land and premises as a whole for the sum of$124,740.00 to 1 Bank, Alpine, Wyoming the said bank having bid fairly and in good faith therefor, and being the highest and best bidder, and that being the highest sum bid for all of said land and premises, being particularly described as follows, to -wit: Lot 12, 13, 14 of Clearview Village II according to the plat recorded May 9, 2008, Document No. 938880, in the Office of the Clerk, Lincoln County, Wyoming. The real property or its address is commonly known as 107711 N US Highway 89, Etna, Wyoming, 83118. SUBJECT to all easements, rights of way, reservations, mineral leases, restrictions and restrictive covenants now of record or in sight and affecting said property. Together with all improvements thereon. 3. That said lands and premises were sold pursuant to that certain Notice of Intent to Foreclose Mortgage by Advertisement and Sale being duly given according to law, and pursuant to the provisions of that certain Notice of Mortgage Foreclosure Sale duly published by law, and under and by virtue of the power of sale and authority contained in that certain Mortgage, dated July 15, 2009, made, executed and delivered by Russell Motzkus and Michelle Motzkus, husband and wife as tenants by the entireties, as Mortgagor, to 1st Bank, Alpine, Wyoming, as Mortgagee, which Mortgage was filed for record in the Office of the County Clerk and Ex-Officio Register of Deeds within and for Lincoln County, Wyoming, on July 24, 2009, in Book 728 at Page 257 et. seq., and which Mortgage was re- recorded in the Office of the County Clerk and Ex- Officio Register of Deeds within and for Lincoln County, Wyoming, on September 10, 2009, at Rec 949383, Book 731, at Pages 597 et. seq. to correct the legal description of the property as originally described in the Mortgage; and that the debt secured by said mortgage deed at the time of said sale, including principal, interest, advances, fees, costs and expenses of foreclosure was the actual sum of $201,111.17. 4. That a Certificate of Sale on Foreclosure was thereafter issued by the undersigned to 1 Bank, Alpine, Wyoming as the purchaser, dated January 25, 2011, which Certificate was recorded on January 25, 2010, in Book 761, at Pages 269 -290, Filing No. 957772, in the office of the County Clerk and Ex-Officio Register of Deeds of Lincoln County, Wyoming, and that a Corrective Certificate of Sale on Foreclosure was thereafter issued by the undersigned to 1st Bank, Alpine, Wyoming as the purchaser, dated May 31, 2011, which Certificate was recorded on June 1, 2011, in Book 767, at Page 469, Receiving 959497, in the office of the County Clerk and Ex- Officio Register of Deeds of Lincoln County, Wyoming 5. That the time of redemption of said premises by Russell Motzkus and Michelle Motzkus, expired on the 25th day of April, 2011, and that Russell and Michelle Motzkus, their heirs, executors, administrators, or assigns have not redeemed said property; that the time in which any judgment creditor of said Russell Motzkus or Michelle Motzkus, or grantee or mortgagee, or any person holding a lien on such premises or property, expired on the 25 of May, 2011, and no such person has redeemed such property, and the purchaser aforesaid is now entitled to a deed for said property and premises. NOW, THEREFORE, KNOW ALL MEN BY THIS DEED, that I, Shane Johnson, Sheriff of said County ofLincoln, State of Wyoming, in consideration ofthe premises, have granted, bargained and sold, and do hereby convey to 1 Bank, Alpine, Wyoming, its successors and assigns, the following described property: Lot 12, 13, 86 14 of Clearview Village II according to the plat recorded May 9, 2008, Document No. 938880, in the Office of the Clerk, Lincoln County, Wyoming. The real property or its address is commonly known as 107711 N US Highway 89, Etna, Wyoming, 83118. SUBJECT to all easements, rights of way, reservations, mineral leases, restrictions and restrictive covenants now of record or in sight and affecting said property.
