HomeMy WebLinkAbout960381CONTRACT FOR DEED $200,000.00 March 1, 2011 000557 FOR VALUE RECEIVED, the undersigned Deon F. Heiner (Buyer) promise(s) to pay Jack S. Rosann H. DeMill, Husband and Wife (mailing address: 809 Corner Ridge Drive, Draper, Utah 84020) "Seller the principal sum of Two Hundred Thousand and No /Dollars ($200,000.00). Principal shall be payable to Seller at the above address in consecutive yearly installments of Ten Thousand and No /100 Dollars ($10,000.00) each year ending December 31, 2011, and continuing installments of $10,000.00 each year until December 31, 2020 and then $20,000.00 each year for five years until December 31, 2025, when the entire balance shall be paid in full. If any installment under this note is not paid when due and remains unpaid after a date specified by a notice to Buyer, the entire principal amount; thereon shall at once become due and payable at the option of the Seller. The date specified shall not be less than thirty (30) days from the date such notice is mailed. The Seller may exercise this option to accelerate during any default by Buyer regardless of any prior forbearance. If suit is brought to collect this note, the Seller shall be entitled to collect all reasonable costs and expenses of suit, including, but not limited to, reasonable attorney's fees. Buyer shall pay to the Seller a late charge of five percent (5 of any installment not received by the Seller within thirty (30) days after the installment is due. Buyer may prepay the principal amount outstanding in whole or in part at any time without penalty, unless the Seller shall otherwise agree in writing. Contract for Deed stands as security for the performance and payments by Buyer. The Buyer will accept the property "AS -IS Once the Buyer has made all the payments specified in the agreement and met all other obligations, the Seller will transfer a valid legal title through a Deed. Through a Contract for Deed, the Seller finances the property that is being sold while keeping the title or deed as security. Taxes and assessments will be paid by the seller as long as no improvements are made to current status of land. The property, as referred to in the Affidavit recorded in Book 437PR, on Page 844, with the Office of the Clerk of Lincoln County, Wyoming. Presentment, notice of dishonor, and protest are hereby waived by all makers, sureties, guarantors, and endorsers hereof. This note shall be the joint and several obligations of all makers, sureties, guarantors, and endorsers, and shall be binding upon them and their successors and assigns.
