JEANNE WAGNER
LINCOLN COUNTY CLERK, KEMMERER, WY
RE: Application for Variance to TSVR Building regulation
Subject:
The location of the leach field for Amended Star Valley Ranch Plat 11 Subdivision, on a
portion of the property, as referred to in the Deed recorded with Document No. 857049, in
Book 426PR, on Page 702, being Lot 11 and Lot 12 of Star Valley Ranch Plat 11, as delineated
on the Plat recorded with Receiving No. 637329, on Map No. 317, all with the Office of the
Clerk of Lincoln County, Wyoming located within HES 63 of Section 30, and the NE1 /4NE1 /4
of Section 31, T35N, R118W, of the 6 P.M., Lincoln County, Wyoming.
1. The true location for the leach field is unknown. The Map to accompany Application for
Amended Star Valley Ranch Plat 11 Subdivision depicts the latest record location obtained
from the Lincoln County Planning department. There are two site plans of record with said
department. Lincoln County did not exercise a final inspection at the time of construction. The
contractor is deceased, therefore notes and /or testimony to the true location is not available. The
length of the leach field of record is unreasonable, and does not conform to more recent records.
2. The special circumstances and conditions have not resulted from any act of the applicant that
was intended to circumvent these regulations.
3. The special circumstances and conditions are such that strict application of the regulation
would inflict undue hardship on the applicant far greater than the protection afforded to the
community by the regulation sought to be varied, at this time.
4. Granting of this variance is the minimum necessary to make it possible for the reasonable
desires for the use of their land and buildings.
5. Granting of this variance will not be injurious to the neighborhood surrounding the land
where this variance is proposed, and otherwise is not detrimental to the welfare of the public.
6. Granting of this variance is consistent with the general purpose and intent of these
regulations.
