Michelle Cole, Mortgagor, to secure the payment of Twenty -Seven Thousand
Dollars ($27,000.00) due with interest thereon at the rate of six percent (6 per year, for
One Hundred Twenty months (120) months, as evidenced in the promissory note dated
September 6, 2011, payable in accordance with the provisions of that certain promissory
note, dated September 6, 2011, hereby mortgages and warrants to Doris Jean Waldvogel
and her successors or assigns, Mortgagee, of Sunnyvale, California to -wit:
SEE ATTACHED DESCRIPTION marked as "EXHIBIT 'A'.
If default occurs in the payment of the indebtedness or in the payment of any
installment thereof, or if default occurs in any of the covenants and agreements hereof,
then the whole indebtedness shall, at mortgagees' option, become due and payable
forthwith, and mortgagee may foreclose this mortgage pursuant to the requirements
outlined in Wyoming Statute §34 4 101 §34 -4 -113.
In the event the Mortgagee dies prior to the fulfillment of the Mortgagor's
obligations under the Promissory Note dated September 6, 2011, all amounts due
Mortgagee by Mortgagor shall paid to the estate of the Mortgagee. Any balance due to
the Mortgagee shall be deducted from Mortgagor's inheritance.
