HomeMy WebLinkAbout961902J EASEMENT MEEKS ENTERPRISES, LLC, a Wyoming Limited Liability Company, of 275 N Piney Cottonwood, Big Piney, WY 83113, grantor, for and in consideration of one ($1) dollar and other good and valuable consideration, in hand paid, receipt of which is hereby acknowledged, grants and conveys to CITY OF KEMMERER, and its heirs and assigns, of 220 Wyoming Highway 233, Kemmerer, WY 83101, grantee, the following described perpetual right -of -way easement for the following purposes and under the following conditions: 1. Purpose of Easement. This easement is for the purpose of providing a perpetual right -of -way easement as described in Paragraph 3, for locating, establishing, placing, constructing, and maintaining a storm sewer line together with appurtenances associated therewith that may include but are not limited to manholes or access points to the storm sewer, together with ingress and egress across adjacent land owned by grantor so grantee and its agents have access to said easement for locating, establishing, placing, constructing, maintaining, and repairing said storm sewer and appurtenances associated therewith. 2. Property Benefitted by Easement. This easement is for the benefit of the real property owned by the grantee and the storm sewer system within the boundaries of C grantee for drainage from streets, curbs, gutters, and land therein. The consideration set forth above constitutes full and final payment N f a for the easement and right of way granted. u7 Z 5. Entire Understanding. The making, execution and delivery of this easement by grantor has been induced by no representations, statements, warranties, or agreements o Z Z Q 1- other than that herein expressed. This easement embodies the entire understanding W 5 Z of the parties and there are no further or other agreements or understandings, written W Y O or oral, in effect between the parties, relating to the subject matter hereof. 0 V Q Z 6. Binding Effect. JAMIE JENKINS Notary Public State of Wyoming County of Sublette My Commission Expires December 27, 2014 000198 EXHIBIT A City of Kemmerer 2011 Elk Street Storm Sewer Repair Meeks Enterprises to City of Kemmerer A storm sewer easement being within Section 24 of the resurvey of T.21N., R.116W., 6 P.M., Town of Diamondville, Lincoln County, Wyoming, and being part of the Meeks Enterprises parcel as described and recorded in Book 607PR on page 879 on file in the Lincoln County Clerk's Office and being more particularly described as follows: Beginning at the South West comer of the parcel of land deeded to Luthy Concrete, Inc. as described and recorded in book 373PR, page 365 at the Lincoln County Clerk's Office where is found an aluminum survey cap on 5/8" rebar. Thence S 90 °00'00" W, 68.02 feet to a point on the easterly most boundary of Elk Street and the City of Kemmerer. Thence N 00 00'00" W along the easterly most boundary of said Elk Street, 27.37 feet to the South East corner of Lot 22, Block 1, of the Fairview Addition to the City of Kemmerer. Thence N 90 °00'00" E along the extension of the north boundary line of said Elk Street, 68.02 feet to a point on the westerly most boundary of said Luthy Concrete, Inc. parcel. Thence S 00 °00'00" E along the westerly most boundary of said Luthy Concrete, Inc. parcel to the South West Comer of said Luthy Concrete, Inc. parcel to the point of beginning of this description, where is found an aluminum survey cap on 5/8" rebar. The easement described herein contains 1862 sq ft more or less. 0001
