SUSSMAN AND PHYLLIS SUSSMAN FAMILY LIVING TRUST. As of 1/1/93 Pinedale Investment, Inc. appointed Operator and Operating Agreement 7/1/95. And for the same consideration the Assignor covenants with the Assignee, its heirs, successors, or assigns: That the Assignor is the lawful owner of and has good title to the interests above assigned in and to said lease, estates rights, and properties, free and clear from all liens, encumbrances or adverse claims: That said lease is valid and subsisting on the land above described, and all rentals and royalties due thereunder have been paid and all conditions necessary to keep the same in full force have been duly performed. This assignment is executed without warranty of title express or implies. Separate assignments of the interests may be executed on officially approved forms by Assignor and Assignee, in sufficient counterparts to satisfy applicable statutory and regulatory requirements. Those assignments shall be deemed to contain all of the exceptions, reservations, warranties, rights, titles, power and privileges set forth herein as fully as though they were set forth in each assignment.
