HomeMy WebLinkAbout963256DEED IN LIEU OF FORECLOSURE KNOW ALL MEN BY THESE PRESENTS that ANTHONY M. MARTINEZ, a single person, Grantor, ofthe County of Lincoln, State of Wyoming, in consideration ofthe sum ofTen and No /100 Dollars ($10.00), and other good and valuable consideration to him in hand paid, receipt whereof is hereby confessed and acknowledged by D.J.'S HOLDINGS, INC., a Wyoming corporation, of 3700 Highway 374, Green River, Sweetwater County, Wyoming 82935, Grantee, has remised, released, and forever quitclaimed and by these presents does for his heirs, executors and administrators, remise, release and forever quitclaim unto D.J.'S HOLDINGS, INC., a Wyoming corporation, its heirs and assigns forever, all such right, title interest, property, possession, claim and demand as he may have or ought to have in or to all of the following described premises, to wit: Diamondville Original Town, Block Eight (8), Lots One (1) through Eight (8), East 97 feet, together with all improvements thereon, and easements, appurtenances and incidents belonging or appertaining thereto, or used in connection therewith; subject, however, to all mining, mineral and other exceptions, reservations, covenants, conditions and rights of way of record. This Deed is an absolute grant of title in effect as well as in form, and is not intended by the Grantor to be a Mortgage. The conveyance herein is subject to acceptance by D.J.'s HOLDINGS, INC., a Wyoming corporation. The Grantor acknowledges that D.J.'s HOLDINGS, INC.'s interest in the above described property shall not merge with the Mortgage, and that the Mortgage encumbering the above described property shall remain in full force and effect until a Mortgage Release is properly recorded by the Grantee and that the within conveyance is made without waiver of any deficiency. The acceptance of this Deed and the consideration therefor shall be evidenced by and be the recorded Release of said Mortgage. The Grantor also hereby releases and waives all rights under and by virtue ofthe homestead exemption laws of the State of Wyoming. TO HAVE AND TO HOLD the said premises unto D.J.'S HOLDINGS, Inc., a Wyoming corporation, its heirs and assigns to its own proper use and behoof forever. So that ANTHONY M. MARTINEZ or no other person in his naive or behalf, shall or will hereafter claim or demand any right or title to the premises or any part thereof, but he and every one of them shall by these presents be excluded and forever barred.
