Box 143, La Barge, WY 83123, a corporation organized under the laws of Wyoming, "Grantor hereby grants and conveys to the State of Wyoming, Department of Environmental Quality, Solid and Hazardous Waste Division, 122 West 25 Street, Herschler Building, 4 Floor West, Cheyenne, WY 82002, (Grantee), its independent contractors, administrators, successors, executors, legal representatives, and assigns, in the following described tracts of land, a non exclusive easement to and from, more particularly described as follows: Legal Description: T26 R113 S14 NE4SE4 (TOTAL 6.42 ACRES) Q and �,�4 T26 R113 S14 NW4SE4 PT NE4SE4 PT (TOTAL 11.10 ACRES) This easement shall benefit and provide ingress and egress to the following described property for the purposes stated below: The Grantor agrees that Grantee may access the above described land for the purpose of groundwater monitoring and, if necessary, installation, operation, and maintenance of a remediation system on the following terms and conditions: 1. Grantee shall give Grantor at least five days notice of its desire to enter on the property for the allowed purposes specifying the areas of the property that Grantee desires to visit. 2. Grantor shall not interfere with the conduct of operations at the site by Grantee or Grantee's independent contractors. Grantor shall not move, damage, destroy, or otherwise interfere with equipment that may be placed or installed at the site by Grantee or Grantee's independent contractors. 3. Grantee access to the property shall not unreasonably interfere with existing uses. 4. Grantee shall provide Grantor with the results of its findings and with details concerning proposed action. 5. The State of Wyoming, the Department of Environmental Quality, and the Solid and Hazardous Waste Division do not waive their sovereign immunity by entering into this agreement and specifically retain immunity and all defenses available to them as sovereigns pursuant to Wyo. Stat. 1- 39- 104(a) and all other law. 00745 6. This easement shall be for a term of ten years and may be renewed by agreement of the Grantor and Grantee.
