COUNTY OF LINCOLN SCRIVENER'S AFFIDAVIT RECEIVED 4/2/2012 at 2:12 PM RECEIVING 963905 BOOK: 784 PAGE: 61 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY JILL LARSON, being first duly sworn, upon her oath deposes and states as follows: 1 I am the Manager of Alliance Title Escrow of Wyoming, LLC, located in Kemmerer, Wyoming. 2. I am familiar with the documents in the chain of title respecting the following described real property: Parcel 2 Lot 4 of the Marx Addition to the Town of LaBarge (vacated) of record in the Office of the County Clerk, Lincoln County, Wyoming, more particularly described as follows: That part of the Northeast Quarter of the Northwest Quarter and Lot 1 (Northwest Quarter of the Northwest Quarter) of Section 7, Township 28 North Range 112 West, within the incorporated limits of the Town of LaBarge, County of Lincoln, described as follows: 00061 Parcel 1 Lot 1 Block 2 of Amended Plat of Red Bluff Addition, Phase 1 to the Town of LaBarge, Lincoln County, Wyoming as described on the official plat thereof. Beginning at a point South 60 °34' East, 715.88 feet from the northwest corner of said Section 7 where found a 2" galvanized steel pipe with brass cap inscribed "IT26NS6 /S7 R112W 1962 Thence North 86 °55.5' East, 778.4 feet to a point of the centerline of Marx Lane; Thence South 04 °35.5' East, 34.6 feet to a 3/8" x 12" steel spike; Thence South 13 °11.5' East, 300.7 feet to a 3/8" x 12" steel spike, Thence South 30 °21' East, 55.7 feet to a 3/8" x 12" steel spike; Thence South 14 °21' East, 99.93 feet to a 3/8" x 12" steel spike on the northerly right -of -way line of State Highway 235; 00062 Thence South 75 °39.5' West, 993.0 feet along said northerly right -of -way line to a point; thence North 05 °07' East, 678.9 feet to the point of beginning. Less and Except the Amended Plat of Red Bluff Addition to the Town of LaBarge, Less and Except the and described in Warranty Deed recorded July 15, 2002 in Book 494PR on Page 196 of the records of the Lincoln County Clerk. Less and Except the and described in Warranty Deeds recorded December 5, 2005 in Book 606PR on Page 653 and 655 of the records of the Lincoln County Clerk. Less and Except the land described in Warranty Deed recorded October 1, 2002 in Book 500PR on Page 527 of the records of the Lincoln County Clerk. 3. Alliance Title Escrow of Wyoming, LLC, prepared a title commitment and other documents were subsequently prepared which contained an incorrect call in the legal description on the above described property. 4. The incorrect call in the legal description reads as follows: Section 7, Township 28 North Range 112 West The correct call for the legal description is "Section 7, Township 26 North Range 112 West 5. The following documents were recorded with the incorrect legal description: Corrective Quitclaim Deed from Joe L. Moore, a single man and James W. Moore, a single man to Jeramy D. Pittsley and Dawn S. Pittsley, husband and wife dated February 4, 2008 and recorded as Instrument 936899 in Book 686 at Page 505 in the records of the County Clerk Office at Lincoln County, Wyoming. A Mortgage executed by Jeramy D. Pittsley and Dawn S. Pittsley on January 21, 2008 and Recorded as Instrument 936558 in Book 685 at Page 162 in the records of the County Clerk Office at Lincoln County, Wyoming. A Certificate of Sale, filed on September 28, 2010, at Reception No. 955732 in Book 754 at Page 515 in the records of the County Clerk for Lincoln County, Wyoming. An Assignment of Certificate of Sale, filed on March 7, 2011, at Reception No. 958375in Book 763 at Page 355 in the records of the County Clerk for Lincoln County, Wyoming. A Sheriff's Deed filed March 7, 2011, at Reception No, 958376 in Book 763 at Page 357 in the records of the County Clerk for Lincoln County, Wyoming. 6. This Affidavit is being filed pursuant to W.S. 34 -1 1 -101, to correct the scrivener's error contained in the above referenced documents and to reflect the correct call in the legal description above contained.
