The plans and /or exhibits sheets attached have been fully explained to the landowner. This agreement includes the right of ingress and egress, and also the right to temporarily operate machinery upon the property for the purpose of hauling materials to the property, storing of materials on the property, performing certain operations such as mixing and processing sand, gravel and other road building materials. Upon completion of the project, the Landowner further permits WYDOT to enter upon said property to remove any equipment and apparatus placed thereon, said permission being conditioned upon WYDOT its agents, employees or assigns restoring the property to its original condition, less normal usage and wear. 1. It is contemplated that there may be cases wherein controlled emission of smoke, fumes, dust and odors will result. In such event, the WYDOT, its assigns and contractors will control said odors and emissions as required and in conformity with existing State and Federal laws. 2. The State of Wyoming and the Wyoming Department of Transportation do not waive sovereign immunity by entering into this contract. 3. WYDOT, its employees, agents and contractor agree to keep the private road from US 30 through the project site open at all times for use by Lessor and Lessor's other Lessees and their agents and employees. 4. WYDOT and its contractor agree to replace the existing cattle guard, fence and gate in their original condition or better upon completion of the project. 5. WYDOT and its contractor agree to place a temporary fence around reclaimed reseeded area to keep cattle out of reseeded land until reseeded area takes hold. 6. In the event cattle are in the area of the leased premises, WYDOT and its contractor will use all reasonable efforts to keep cattle off the highway and close gates when site is not in operation.
