AFFIDAVIT OF OWNERSHIP

BEFORE ME, the undersigned authority, on this day personally appeared Earnest Casstevens,
known to me to be a credible person, who after having been first duly sworn on oath deposes and says the
following:
"My name is Earnest Casstevens and I am over twenty -one (21) years of age, and I am a resident of
Travis County, Texas, my address being 113 Laura Lane, Rollingwood, Texas 78746. I am familiar with
the marital and family history of Arthur Lawrence Wright and Deborah Diane Gordon, both deceased.
Arthur Lawrence Wright died testate; and his wife Deborah Diane Gordon was the sole beneficiary under
his will. His will, in which he bequeathed all his property to his wife, Deborah Diane Gordon, was filed
for and admitted to probate on February 9, 2005, with Letters Testamentary issued to Deborah Diane
Gordon who was appointed Independent Executor of the Will and Estate of Arthur Lawrence Wright, in
the Probate Court No. 1 of Travis County, Texas under Cause No. 82421, and vested all right, title and
interest in the property of Arthur Lawrence Wright into Deborah Diane Gordon.
Arthur Lawrence Wright was a beneficiary of a trust (the Wright Children Trust) created by his father,
Harold Eugene Wright, who was a geologist in the oil and gas business. The Trust terminated according
to its terms on August 6, 1977; but certain assets including numerous mineral interests, more particularly
described in a Mineral and Royalty Deed, and approximately $20,000 in cash remained undistributed after
the Trust terminated. On November 9, 2009, the 241S District Court of Smith County, Texas, signed an
order requiring distribution of the remaining assets of the Wright Children Trust one -third each to Amy
Lucille Wright, Bradley Sloan Wright, and Deborah D. Gordon as independent executor of the Estate of
Arthur Lawrence Wright. Thereafter, on February 2, 2011, the Successor Trustee of the Wright Children
Trust executed the Mineral and Royalty Deed conveying all the mineral interests remaining in the Wright
Children Trust one -third each to Amy Lucille Wright, Bradley Sloan Wright, and the Estate of Deborah
Diane Gordon.
Deborah Diane Gordon was murdered by her subsequent husband, John Malcolm Nordstrom III, in
Austin, Travis County, Texas, on or about August 5, 2010. On December 9, 2011, John Malcolm
Nordstrom III was convicted of her murder and sentenced to 50 years in prison.
On January 30, 2012, the District Court of Travis County, Texas, 53 Judicial District, rendered a final
judgment in Cause No. D- 1- GN -1 1- 003 897, Jerry Casstevens and Earnest Casstevens v. John Malcolm
Nordstrom III, imposing a constructive trust in favor Jerry Casstevens and Earnest Casstevens on the
property of Deborah Diane Gordon. John Malcolm Nordstrom III, who willfully and wrongfully caused
the death of Deborah Diane Gordon, was her sole devisee or heir and would have obtained her property
by devise or descent if a constructive trust had not been imposed on her property. Deborah Diane Gordon
had no children; and both her parents preceded her in death. Jerry Casstevens and Earnest Casstevens
were the only siblings of Deborah Diane Gordon, and were her next of kin other than her murderer.
The judgment of the 53r District Court in Cause No. D- 1- GN -11- 003897 imposed "a constructive trust in
favor of Jerry Casstevens and Earnest Casstevens and their heirs, assigns, devisees, and successors in
interest, on all right, title and interest in and to the property of Deborah Diane Gordon, Deceased,
including Deborah Diane Gordon's undivided mineral acres in the western half of Section 282, Block G,
W.T. RR Co. Survey in Gaines County, the mineral interests conveyed by the Mineral and Royalty Deed
attached hereto as Exhibit C [conveying all remaining assets of the Wright Children Trust to Amy Lucille
Wright, Bradley Sloan Wright, and the Estate of Deborah Diane Gordon, 1/3 each], and any and all other
mineral interests and other property inherited by or vested in Deborah Diane Gordon from Arthur
Lawrence Wright, Deceased, pursuant to the Order attached hereto as Exhibit D or the Will of Arthur
Lawrence Wright attached hereto as Exhibit B that have passed or would otherwise pass to John Malcolm
Nordstrom III by either descent or devise, each Plaintiff to receive one -half ownership of said property."
The judgment further "ordered, adjudged, and decreed, that Plaintiffs, Jerry Casstevens and Earnest
Casstevens, have of and against the Defendant John Malcolm Nordstrom III a final judgment in their
favor from this Court conveying title to the above described mineral acreage and other interests to
Plaintiffs [Earnest Casstevens, 113 Laura Lane, Austin, Texas, and Jerry Casstevens, 8511 Miami
Avenue, Lubbock, Texas] and their heirs, assigns, devisees, and successors in interest," including the
mineral and royalty interests in Lincoln County, Wyoming conveyed to the Estate of Deborah D. Gordon,
by the aforementioned Mineral and Royalty Deed recorded in the Real Property Records of Lincoln
County at Volume 774, Page 418.
A certified copy of said Judgment has been filed in the Travis County Texas Clerk's Office located in
Austin, Texas under File #2012037871.
