A. Developer is the developer of the "River Bend Meadows" Subdivision in Lincoln County Wyoming (the "Original Subdivision which is subject to the Original Declaration. B. Developer owns (among other Lots and Common Areas within the Subdivision) Common Area Lot 39 of the Original Subdivision, as shown on the official plat thereof filed November 29, 2006, as Receiving No. 924843, Map No. 217 -A, in the Office of the Clerk of Lincoln County, Wyoming "Common Area Lot 39 C. Developer is also the owner of the land described as Lot 3 of Deer Run, 2nd Filing, Lincoln County, Wyoming, according to that plat filed July 7, 2004 in the office of the Lincoln County Clerk, Plat No. 140.B, Instrument No. 900938 (the "Additional Land immediately adjacent to the Original Subdivision. D. Developer desires to make the Additional Land part of the River Bend Meadows Subdivision, and subject to the Original Declaration and this Supplemental Declaration, notwithstanding the fact that the Additional Land is also part of the Deer Run Subdivision. Now therefore, Developer for itself, its successors and assigns, hereby declares that the Original Subdivision and the Additional Land, whether or not referred to in any deed of conveyance of such land, at all times is and shall be held transferred, sold, conveyed and occupied subject to the Original Declaration and this Supplemental Declaration as follows. 1. As provided in Section 1.4 of the Original Declaration, Developer hereby declares that, in addition to the Original Subdivision, the Additional Land is and shall be subject to the covenants, conditions, restrictions and easements set forth in the Original Declaration and this Supplemental Declaration. 00070 2. The Original Declaration is hereby amended and supplemented as provided herein, and the Original Subdivision and the Additional Land are and shall be subject to the covenants, conditions, restrictions and easements (the "Covenants set forth in this Supplemental Declaration. 3. The Additional Land shall be considered a Residential Lot or "Lot" as described in the Original Declaration. 4. The record owner of the Additional Land, whether one or more individuals or entities, shall be considered an "Owner and "Member" of the River Bend Meadows Home Owners Association "HOA as described in the Original Declaration. 5. Developer, as owner of Common Area Lot 39, hereby grants to Developer as owner of the Additional Land, a non exclusive easement for ingress, egress, utilities and related improvements over, under and across that portion of Common Area Lot 39 described in attached Exhibit A (and depicted on attached Exhibit B). Any use of this easement area by Developer and /or the HOA shall not unreasonably interfere with the use of this easement by the owner of the Additional Land. 6. Developer, as owner of the Additional Land, hereby grants to Developer and the HOA a non exclusive easement, for ingress, egress, road improvements, signage, landscaping, utilities and all other improvements deemed reasonable by Developer and /or the HOA, over, under and across the north 200' of the Additional Land as shown on Map 217 -A (and depicted on attached Exhibit B). Any use of this easement area the owner of the Additional Land shall not unreasonably interfere with the use of this easement by Developer and /or the HOA. 7. This Supplemental Declaration, and the easements granted herein, shall become effective upon recordation in the real estate records of Lincoln County, Wyoming, and shall run with the land, and shall be binding upon and inure to the benefit of Developer's successors and assigns.
