HomeMy WebLinkAbout965540WHEREAS, on March 5, 2012 a petition was filed with the Town Council of the Town of Diamondville, County of Lincoln, State of Wyoming, by a majority of the adjoining property owners and praying said Town Council to vacate a parcel of land being part of the vacated portion 1 1 th Street of the 1942 plat of the Town of Diamondville, Wyoming and being within Section 25 of the resurvey of T.21N., R.116W., 6 P.M., Town of Diamondville, Lincoln County, Wyoming. Said portion of vacated 11 Street being more particularly described as follows: Commencing at the southeast corner of Lot 3 of Block 33 of the 1942 plat of the Town of Diamondville, Wyoming where is found a rebar with no cap. Thence S 11 °11'00" E along the east boundary of said Block 33, 210.01 feet to a point where is found a rebar with no cap. Said point also being the southeast corner of Lot 10 of said Block 33 Thence N 78 °50'00" E, 10.00 feet to a point where is found a rebar with aluminum cap stamped "CCI PELS 5465" hereafter referred to as a CCI cap. Said point also being the Point of Beginning of this description. Thence continuing N 78 °50'00" E, 10.00 feet to a point where is found a CCI cap. Said point also being a point on the easterly boundary of said 1942 Plat of the Town of Diamondville Thence S 11 °10'00" E along the easterly boundary of said 1942 Plat 60.00 feet to a point where is found a CCI cap. Said point also being the southeast corner of said 1942 Plat. Thence S 79 01'36" W, along the south boundary of said 1942 Plat and said vacated 11th Street 160.15 feet to a point where is found a CCI cap; Thence N 11 °10'00" W along the extension of the west boundary line of said Block 33, 29.85 feet to appoint where is found a CC1 cap: Thence N 78 °58'59" E, 150.15 feet to a point where is found a CCI cap. Thence N 11 °10'00" W, 30.00 feet to the point of beginning of this description The parcel described herein contains 0.12 acres more or less. WHEREAS, according to the minutes of the Town of Diamondville, it having been shown to said Council by satisfactory evidence that the portion of said street to be vacated has not been used by the public and is not necessary for use by the public; and WHEREAS, this matter having been duly noticed for public hearing and that hearing having taken place on May 7 2012; an no one having objected to the vacation of that portion of 11 Street, Lot 10, Block 33, of the 1942 Plat of the Town of Diamondville as described above and ap roved by the Mayor and Clerk to issue the deed to the adjoining property owner with a motion by Council Member d second by Council Member Cl�Rlislp and WHEREAS, the present Council has reviewed this matter and is of the opinion that the proper procedure was followed with the exception of a resolution being passed and recorded. BE IT HEREBY RESOLVED that the Town Council of the Town of Diamondville hereby confirm and ratify the vacating commencing at the southeast corner of Lot 10 Block 33 of the 1942 Plat of the Town of Diamondville and the issuance of the proper deed to the adjoining owner. r DULY PASSED AND ADOPTED this cl day of July 2012.
