COMES NOW, Mark A. Hunter and Linda B. Hunter (Hunters), whose address is 240 River
Rock Road, Smoot, Wyoming, AND Ted N. Carlisle and Kathleen A. Carlisle (Carlisles), whose
address is 2800 County Road #140, Smoot, Wyoming being duly sworn on oath according to
law, do hereby make the following statements of facts and affirm:
1. That Hunters are the owners of Lot 1 of Country Haven, a subdivision of record in the
Office of the Clerk of Lincoln County.
2. That Carlisles are the owners of that tract of record in the Office of the Clerk of Lincoln
County, Wyoming in Book 751 PR 744.
3. That they share a common boundary line as depicted on said Country Haven.
4. That the attached Exhibit shows the common boundary line, which is the Cottonwood
Irrigation pipeline, as marked on the ground and described in the Certificate of Surveyor of
said Country Haven.
5. That there is an existing fence line approximately five (5) feet south of said boundary line,
and that Hunters and Carlisles do not recognize said existing fence line as the boundary line,
and that it is a fence of convenience.
6. That Hunters and Carlisles have agreed to construct a new fence line along the common
boundary line, said fence to be constructed as shown on the attached exhibit.
7. That when said fence is constructed, Hunters and Carlisles agree to share equally in the
labor and materials to construct the fence and to maintain the fence.
8. That when the fence is constructed, it will not constitute a boundary fence but remain a
fence of convenience.
9. That this agreement is binding on the heirs, successors and assigns of Hunters and Carlisles.
