George A. Wakefield and Harvey H. Wakefield heretofore filed an application
to the Court for a Decree of Summary Distribution of Real Property. Said
application came this day regularly to be heard, proof having been made to the
satisfaction of the Court that notice of distribution of said real property has been
given in the manner and for the time required by law; and the Court, being fully
advised in the premises, finds:
1. George William Drube, also known as George W. Drube, died intestate on
April 26, 2012, at Rock Springs, Sweetwater County, Wyoming. At the time of his
death he was eighty four (84) years of age, was a resident of the State of Wyoming
and resided at 1146 Coal Creek, Diamondville, Lincoln County, Wyoming.
2. The value of decedent's entire probatable estate, wherever located, less
liens and encumbrances, including the real property which is the subject matter
herein, does not exceed $200,000.00.
3. More than thirty days elapsed between the date of death of decedent and
the date Petitioners filed their Application for Decree of Summary Distribution of
Real Property.
4. No application for the appointment of a personal representative is
pending or has been granted in any jurisdiction.
5. Decedent died without a will. Pursuant to the laws of intestacy for the
State of Wyoming, the Petitioners George A. Wakefield and Harvey H. Wakefield,
being the surviving nephews of the decedent, are the only heirs or distributees
entitled to payment or delivery of the real property that is the subject matter of
this petition. The Petitioner left no surviving wife; left no surviving children or any
descendants of any surviving children; and left no surviving father, mother,
brother, nor sister. The Petitioners are the surviving children of the decedent's
late sister, Margie L. Wakefield.
6. There are no other distributees or heirs of the decedent having a right to
succeed to said real property under probate proceedings.

7. At the time of his death the decedent was the owner of an undivided one
half (1/2) interest in a parcel of real property located in Lincoln County, Wyoming,
more particularly described as follows:
LOT 35, SPRING CANYON RANCH SUBDIVISION, LINCOLN COUNTY,
WYOMING.
8. Attached to the Application for Decree of Summary Distribution of Real
Property is a sworn Report of Appraisal made by Cindy A. Gramke a
disinterested person, reporting that decedent's undivided one -half (1/2) interest in
said real property had a maximum fair market value of 75,000.00 as
of the date of decedent's death.
IT IS THEREFORE, ORDERED ADJUDGED AND DECREED that George A.
Wakefield and Harvey H. Wakefield are hereby determined to be the only heirs at
law entitled to payment or delivery of decedent's undivided one -half (1/2) interest
in said real property; and that there are no other distributees or heirs of the
decedent having a right to succeed to said real property interest under probate
proceedings.
IT IS FURTHER ORDERED, ADJUDGED AND DECREED that all of the
decedent's right, title and undivided one -half (1/2) interest in the above described
real property be, and the same is hereby, distributed, granted, conveyed and set
over to George A. Wakefield and Harvey H. Wakefield, as tenants in common.
IT IS FINALLY ORDERED that, pursuant to Section 2 -1 -205, W.S.A. (2011),
a certified copy of this Decree shall be filed with the County Clerk and Ex- Officio
Register of Deeds in and for the County of Lincoln, State of Wyoming, this decree
being presumptive evidence of the title to the aforementioned real property.
