Allred, husband and wife, of 2372 State Highway 236, Afton, WY 83110, grantors, for and in consideration of Ten Dollars ($10.00) and other valuable consideration, in hand paid, receipt of which is acknowledged, grant and convey to Cory Frome and Jennifer Lee Frome, husband and wife, of 2332 State Highway 236, Afton, WY 83110, grantees, the following described perpetual right of way easement for the following purposes and under the following conditions: 1. Purpose of Easement. This easement is for the purpose of providing perpetual, nonexclusive ingress and egress and all necessary access to construct, install, operate and maintain an irrigation pipeline over, across, and along a five -foot (5') wide strip of land to provide irrigation water to lands owned by the grantees to enter upon the lands of the undersigned, situate in the County of Lincoln, State of Wyoming, said easement being more particularly described in paragraph 4 below. Grantees and their successors and assigns are hereby granted the right to construct, install, operate, and maintain an underground irrigation water pipeline over, across and along the above described 5 -foot wide easement to such extent as is deemed necessary to construct, install, maintain and repair an underground irrigation pipeline to carry irrigation water to grantees' lands. 2. Conditions of Easement. The condition of this easement is that upon any construction or maintenance being performed on the pipeline in the easement Grantees shall restore the Grantors' property to its prior condition by re- contouring or re- seeding the land as necessary. 3. Property Benefitted by Easement. This easement is for the benefit of the following described real property of the grantees in Lincoln County, Wyoming: Jennifer Lee Frome and Cory Frome Real Property: That part of the SE1 /4SE1/4 of Section 3, T31N R119W of the 6th P.M., Lincoln County, Wyoming and part of those tracts of record in the Office of the Clerk of Lincoln County in Book 159 PR on page 605 and Book 194 PR on page 189 and Book 619 PR on page 497 more particularly described as follows: BEGINNING at a point on the South line of said Section 3, East, 7.81 feet from the Southwest corner of the said Southeast Quarter of the Southeast Quarter found as described in the Certified Land Corner Recordation Certificate filed in the said Office; thence continuing East, 100.00 feet along the said South line to a point; thence North 01 °00.1' East, 435.60 feet to a point; thence West, 100.00 feet to a point; thence South 01 °00.1' West, 435.60 feet along an existing fence in part to the POINT OF BEGINNING. 4. Description of Easement. The easement is described as follows: That part of the S1/2SE1/4 of Section 3, T31N R119W of the 6th P.M., Lincoln County, Wyoming, being part of those tracts of record in the Office of the Clerk of Lincoln County in Book 101 PR on page 109 and in Book 356 PR on page 879, more particularly described as the East 5 feet of the attached "Description for Loa A. Binding Effect. The terms and conditions of this easement shall be binding upon and inure to the benefit of the heirs, successors in interest and assigns of the parties named in this instrument. 6. Waiver of Homestead Rights. The grantors hereby waive and release all rights to the described easement under and by virtue of the homestead exemption laws of the State of Wyoming to the extent that such rights may interfere with the purposes of this easement.
