HomeMy WebLinkAbout968239REAL ESTATE SALE PURCHASE AGREEMENT FOR THE PROPERTY LOCATED AT 130 PERKINS ROAD THAYNE, WYOMING BETWEEN RECEIVED 11/30/2012 at 10:16 AM RECEIVING 968239 BOOK: 799 PAGE: 372 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY STEVEN H SIMPSON AND REBECCA J SIMPSON (SELLERS) AND JEREMY SCOTT NELSON AND /OR MEGHAN NELSON (BUYERS) This Real Estate Sale/Purchase Agreement is made and entered into this 26th day of November, 2012, by and between STEVEN H SIMPSON and REBECCA J SIMPSON, husband and wife, as tenants by the entireties, Thayne, Wyoming 83127 and JEREMY SCOTT NELSON and MEGHAN NELSON, husband and wife, as tenants by the entireties, Thayne, Wyoming 83127. WITNESSETH: That for and in consideration of the payments to be made, and the covenants made to be kept and preformed, Sellers agree to sell, and Purchasers agree to purchase the property located in Lincoln County, Wyoming, more particularly described as follows, to -wit: A portion of the property referred to in Instrument No. 865637 recorded May 1, 2000, in Book 445PR on Page 55 of the records of the Lincoln County Clerk, all in the Northeast Quarter of the Southwest Quarter of Section 11, Township 34 North, Range 119 West of the 6 P.M., Lincoln County, Wyoming, and being more particularly described as follows: BEGINNING at the B.L.M. type Monument marking the Baker Engineers PE/LS 698 location for the Northwest corner of said Northeast Quarter of the Southwest Quarter (CW1/16S11) and said property; thence South 88 degrees 53'08" East, along the North line of said property, 261.45 feet to an Iron Pipe set marking the Northeast corner of said property; thence South 0 degrees 08'17" West, along the East line of said property, 172.03 feet to an Iron Pipe set; thence North 88 degrees 43'34" West, to 261.47 feet to an Iron Pipe set at a point in the West line of said property; thence North 0 degrees 08'17" East, along said West line, 171.30 feet, to the POINT OF BEGINNING. ADDITIONAL TERMS: 1) The property will be accepted in "as is" condition, beginning 11/26/2012. 2) The sellers stipulate that the property has no liens attached to it and maintain a clear title to the property and clear title is now transferred to Jeremy Scott and Meghan Nelson. 3) Sellers state that they will be responsible for the 2012 property taxes. Buyers will be responsible for property taxes thereafter. 4) Since the Sellers presently hold Title Insurance, with the Deed free and clear of any liens or holdings, new title insurance will not be required from Sellers. 5) The sellers will have an attached "1 Mortgage Lien" to this property until mortgage loan is satisfied. 6) The sellers retain first option to repurchase this property if and when buyers decide to sell said property. 7) The buyers will carry real estate insurance on said property to adequately cover the financial obligation to sellers due to any unforeseen property loss. 8) The terms and conditions of this contract apply to and are binding on the heirs, successors and executors of both said parties. FINANCIAL AGREEMENTS: 1) Purchase price shall be One Hundred Thirty -Eight Thousand dollars. 2) Buyers have paid a down payment of Five Thousand dollars. ($5000.00) 3) Sellers agree to finance the balance of $133,000.00 at 3.75% interest rate on a 12.5 year amortization schedule. 4) An $1112.00 monthly payment will be the Simpsons on the first day of each month, beginning January 01, 2013. 5) Sellers retain the right to regain all property if buyers default on payment(s). 6) Sellers will pay all document recording and filing fees. This two page Agreement constitutes the entire understanding and agreements between both parties relating to the subject matter hereto. IN WITNESS WHEREOF, this agreement has been executed in triplicate by the respective parties. 1 copy to Buyers, 1 copy to Sellers and 1 copy attached to the Deed filed with the Lincoln County Clerk, Kemmerer, Wyoming.
