HomeMy WebLinkAbout968335SHERIFF'S DEED 80 THIS SHERIFF'S DEED, executed following a foreclosure sale by o the undersigned Sheriff of Lincoln County, Wyoming, as Grantor and The Bank of Commerce, an Idaho banking corporation, as Grantee. CO CO WHEREAS, a Mortgage was made and dated June 29, 2007, from °'c Mortgagor, JM Land Development, LLC, an Idaho limited liability P m a E company, Sherry Merritt, individually and Joel Merritt, and Sherry roa E Merritt, husband and wife, payable to Lender and Mortgagee, The Bank of Commerce Eastside, which Mortgage was recorded on September 12, 2007, in the Office of the County Clerk of Lincoln County, Wyoming in Book 672 PR, Page 49; and WHEREAS, at the request of The Bank of Commerce, an Idaho banking corporation, as Mortgagee and the owner and holder of said Mortgage, and in compliance with the published Notice of Foreclosure Sale, and pursuant to law, the Sheriff or authorized Deputy Sheriff did hold the sale as provided in the Notice and The Bank of Commerce, an Idaho banking corporation, made the highest bid and the undersigned accordingly sold the property for the sum of $582,311.00 the best bid offered; and WHEREAS, a Certificate of Sale was issued by the Lincoln County Sheriff or Authorized Deputy Sheriff, to the high bidder, The Bank of Commerce, an Idaho banking corporation, which Certificate of Sale was recorded in the office of the County Clerk and Ex- Officio Register of Deeds for Lincoln County, Wyoming, on January 17, 2012, in Book 779 at page 349; and WHEREAS, three months and thirty (30) days having passed since the date of sale, neither the mortgagor nor anyone in their behalf or any creditor of the mortgagor has redeemed from the sale and the purchaser has now become entitled to a deed to the premises; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that I, M. Shane Johnson, Sheriff of Lincoln County, Wyoming, and in consideration of the premises and the bid amount, have granted and sold and do hereby convey to The Bank of Commerce, an Idaho banking corporation, of P.O. Box 1887, Idaho Falls, Idaho, 83403, and its successors and assigns, the following described real property situated in Lincoln County, State of Wyoming: Northeast Quarter of the Northwest Quarter and GLO lot 1 of Section 19, Township 34 North Range 118 West of the 6 P.M., Lincoln County, Wyoming. LESS AND EXCEPT the land described in Quitclaim Deed recorded October 4, 2004 in Book 569PR on page 17 of the records of the Lincoln County Clerk; and LESS AND EXCEPT the land described in Quitclaim Deed Recorded October 4, 2004 in Book 569PR on page 19 of the records of the Lincoln County Clerk; and ALSO, LESS AND EXCEPT the land described in Warranty Deed recorded August 7, 2007 in Book 668PR on page 140 of the records of the Lincoln County Clerk. SUBJECT TO all of the terms, conditions, restrictions, grants and plat warnings set forth on the official plat of the North Forty Phase One Subdivision, a/k/a North Forty Subdivision, filed with the County Clerk of Lincoln County, Wyoming on July 6, 2007, as Receiving 930990.
