WARRANTY DEED
(Boundary Adjustment)
Troy Nield, Trina Lancaster, Toby Nield, and Tara Erickson, grantors of the
County of Lincoln, and State of Wyoming, for and in consideration of TEN
DOLLARS ($10.00) and other valuable consideration, in hand paid, receipt of which
is hereby acknowledged, CONVEY AND WARRANT to Loa June Nield, a single
person, grantee of County of Lincoln, State of Wyoming, the following described real
estate situated in County of Lincoln and State of Wyoming, hereby releasing and
waiving all rights under and by virtue of the homestead exemption laws of the
State, to -wit:
Exhibit A "Description for Loa Nield Loa Nield Tract" prepared by
Surveyor Scherbel, Ltd. attached hereto and made reference to as if
fully set forth herein and incorporated.
Together with all water rights, mineral rights, improvements and
appurtenances thereon situate or in anywise appertaining thereunto. Subject,
however, to all reservations, restrictions, exceptions, easements and rights -of -way of
record or in use.
Subject also to the right of Grantor and Grantee, and their heirs, successors
and assigns, for as long as either owner desires use, to the use of the water line that
runs along the common boundary of Grantor's and Grantee's properties. Grantor
and Grantee hereby grant to each other an easement, of five feet on either side of
their common property boundary, for use, maintenance, and repair of the water
line. Grantor and Grantee agree to share equally the costs of maintenance and
repair of the water line so that it is maintained in a reasonable, operational
condition, but Grantor or Grantee shall be solely responsible for any costs for the
water line that arise from any damages to the water line cause by that party's
negligence or deliberate acts during use of the water line or their properties. If one
party no longer desires use of the water line, that party shall notify the other party
in writing of that party's abandonment of use and, thereafter, the party continuing
to use the water line shall be solely responsible for the costs of such use.
This is a boundary adjustment, Grantors warrant title to that part of the
described land outside of the land previously conveyed to the Grantee in instrument
recorded in Book 695 Page 569 of the official records of the Lincoln County Clerk for
and in the County of Lincoln, State of Wyoming.
