HomeMy WebLinkAbout871036Cougar Ranch, a Limited Partnership, Grantor(s), of Etna, Lincoln County, State of Wyoming, hereby convey, grant and release to the Etna, Wyoming Water and Sewer District, Grantee, of Lincoln County, State of Wyoming, for the sum of Ten Dollars ($10.00) and other valuable consideration, a perpetual easement and right -of -way for the installation, and continued maintenance of a waterline, tank drainline, and related facilities over, under, and through the premises of the Grantor(s) in Lincoln County, State of Wyoming, said easement being one rod (16.5 feet) wide, the centerline of which is described as follows: Beginning at a point on the east line of the Metcalf property as recorded in Book 390pr, page 378 in the office of the Lincoln County Recorder, which point is West 337 feet (record), and North 20.5 feet of the SE corner of the NW% of Section 12, T35N, R119W, Lincoln County, Wyoming, which point is in the south borrow ditch of an existing two -track roadway. And running thence Easterly along said borrow ditch 338 feet more or less to a point on the East line of the NW% of said Section 12, which the point is 42 feet North of the SE corner of the NWY4 of Section 12; Grantor(s), for the consideration aforesaid, hereby agree not to construct or maintain any building or structure of a permanent nature upon the perpetual easement above described. Together with all rights of ingress or egress necessary or convenient for construction of a waterline, storage tank and related facilities over, under and through the premises of the Grantor(s) in Lincoln County, State of Wyoming. All construction related disturbance(s) will be reclaimed by the Grantee, or its agent, upon the completion of waterline, storage tank and related construction. Said easement and right -of -way is granted with the understanding and the condition that the Grantor(s) be reimbursed by the Grantee(s) for any damage caused by its employees or agents in the construction or the maintenance of said water line. Grantor will allow the use of the existing two -track roadway for construction and operational access provided that said roadway will not be improved or made permanent. Access will be limited to the District's employees and agents soley for the purposes of constructing, operating, and maintaining the District's water system. 2. The Etna Wyoming Water and Sewer District agrees to reserve a right unto Grantor (or Assigns) for up to three future 3/4 -inch service connections to the municipal waterline. The cost of the service connections (including up to 50 feet of service line to Grantor's properties) will be born by the District. Grantor agrees to pay monthly user rates in accordance with the District's standard rate structure and user agreement commencing at such time as the service connection is made. Said services will be located in the NW% of section 12, the SE'/NW% of Section 11, and SW %NE%4 of Section 11 respectively, all in T34N R119W, 6` P.M. ()--7) —0° C Date Attest 776
