HomeMy WebLinkAbout970794MORTGAGE DEED REX DOORNBOS and SARAH DOORNBOS, husband and wife, MORTGAG- ORS, of Lincoln County, State of Wyoming, to secure the payment of TWO HUNDRED THOUSAND AND NO /100 Dollars ($200,000.00), due May 1, 2033, with interest from May 1, 2013 at the rate of three and one fourth percent (3.25 per annum, payable monthly, evidenced by one installment note of even date herewith, MORTGAGOR, do hereby mortgage to ALVIN H. DOORNBOS and DONNA DOORNBOS LIVING TRUST DATED JULY 27, 2011, ALVIN H. DOORNBOS AND DONNA DOORNBOS, TRUSTEES, MORTGAGEE, whose address is 664 Beartooth Ct., Powell, Wyoming 82435, the following described real estate situate in the County of Lincoln, State of Wyoming, hereby relinquishing and waiving all rights under and by virtue of the homestead exemption laws of the State, to -wit: Lot 7 of Misty Meadow Estates Subdivision within the E /2 of Section 22, T. 36 N., R. 119 W., as said subdivision is laid down and platted in the Office of the Lincoln County Clerk, Wyoming. Together with all improvements thereon and appurtenances and hereditaments thereunto or in anywise appertaining. In case of any default whereby the right of foreclosure occurs, MORTGAGEE shall at once become entitled to exclusive possession, use and enjoyment of the property and all rents, issues and profits thereof from the accruing of such right and during the pendency of foreclosure proceedings and the period of redemption, if any there be, and such possession, rents, issues and profits shall at once be delivered to MORTGAGEE on request. On refusal, the delivery of such possession, rents, issues and profits may be enforced by MORTGAGEE in an appropriate civil suit or proceeding. The MORTGAGORS agree to pay the indebtedness hereby secured, and to pay all taxes and assessments on said premises and to keep the buildings thereon insured in a sum not less than Two Hundred Thousand and no /100 Dollars ($200,000.00) during the life of this mortgage, in favor of and payable to the MORTGAGEE, and in case the MORTGAGOR shall fail to pay such taxes and assessments and to keep the premises insured as aforesaid, the MORT- GAGEE may insure said buildings and pay said taxes and assessments, and all (GR00 RECEIVED 5/2/2013 at 4:03 PM RECEIVING 970794 BOOK: 810 PAGE: 600 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY sums so paid shall be added to and considered as a part of the above indebtedness hereby secured, and shall draw interest at the same rate. MORTGAGOR does further agree to keep the premises free of all mechanic's liens, tax liens, or encumbrances of any kind which could be superior to this mortgage interest. In case default shall be made in the payment of the above sum hereby secured, or in the payment of the interest thereon, or any part of such principal or interest, when the same shall become due, or in case default shall be made in any of the covenants and agreements hereof, then the whole indebtedness hereby secured with the interest thereon shall become due and payable, and the MORTGAGEE, its legal representatives or assigns may proceed, to enforce the provisions of this mortgage, either by suit at law or in equity, as it may elect, or to foreclose this mortgage by advertisement and sale of the above described premises, according to Wyoming statutes governing mortgage foreclosures, and out of the proceeds of such sale shall pay all sums due hereunder, together with all costs of sale and foreclosure, including a reasonable sum as attorney's fees.
