HomeMy WebLinkAbout971050RECEIVED 5/17/2013 at 3:17 PM RECEIVING 971050 BOOK: 811 PAGE: 802 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY Loan RR00706414/RR014416R4 AGREEMENT ASSUMING MORTGAGE AND REVISING INDEBTEDNESS AND TERMS PAYMENT THEREOF (CONVENTIONAL) This agreement, entered into this J day of ,R( 0 15 by and between Bank of the West, a Califomia state banking corp. the undersigned "Lender," d DEBBIE SHUMAN hereinafter called "Borrower WHEREASE, Borrower desires to purchase the following described real estate: 521 PEARL STREET, Kemmerer and WHEREAS, there is recorded in the Mortgage Records of Lincoln County, WYOMING in Book 732 Page 163 a Mortgage/Deed of Trust, hereafter called the "Security Instrument" on said real estate, dated September 14, 2009 in favor of Bank of the West, a California state banking corp. and WHEREAS, Borrower, as a part of the purchase price for said real estate desires to assume said Security Instrument and the indebtedness and obligation secured thereby; and WHEREAS, Lender has agreed to forego the exercise of its option to declare the whole amount of the present unpaid indebtedness secured by said Security Instrument due and payable by reason of the impending change of ownership in the above described real estate if certain hereinafter described modifications and amendments are made in the rate of interest and terms if payment of said Security Instrument and the obligations secured thereby. NOW, THEREFORE, for the value received and in consideration of the premises and of the mutual promises of the parties hereto, it is mutually agreed that the Promissory note and the Security Instrument securing the payment thereof be revised and amended in the following particulars: This total amount of indebtedness of Borrower to Lender on account of the herein before described Note and Security Instrument as of the date hereof including all principal and interest due is Fifty Thousand Four Hundred Two And 83/100 Dollars 50,402.83 hereinafter referred to as the "principal balance." II. Borrower, jointly and severally, promises to pay the Lender, or order, at any designated place, the principal amount ofFifty Thousand Four Hundred Two And 83/100 Dollars 50,402.83 together with interest thereon at the rate of 5.000 percent per annum, in monthly installments of Four Hundred Seventy Eight And 43/100 Dollars 478.43 beginning April 01, 2013 It is understood and agreed by the undersigned that the herein before described Security Instrument, except as amended herein, shall constitute and remain as security for the payment of the amount due, as above set forth, and that all terms and conditions of said Security Instrument, except as herein specifically amended, shall remain in full force and effect.
