through EVERETT E. DAYTON's probate proceeding. The Court hereby takes judicial notice
of the Application for Decree Establishing Right and Title to Real Property filed with the Clerk
of the Third District Court, Lincoln County, Wyoming in Docket Number 5 -4041, establishing
DR. RICHARD E. DAYTON and ROBERT M. DAYTON as the persons entitled to delivery of
EVERETT E. DAYTON's property. There are no other distributees of the Decedent having a
right to succeed to any of the property of the Decedent under probate proceedings.
4. The value of the entire estate of said Decedent, wherever located, does not exceed
$70,000.00 and a sworn report of appraisal, made by an independent appraiser who has no legal
interest in the estate, has been filed herein.
5. More than thirty (30) days have elapsed since the date of death of the Decedent.
6. No application for the appointment of a personal representative of said Decedent
is pending or had been granted in any jurisdiction.
7. Among the assets owned by the Decedent, in her sole and separate name, were the
following real property interests located within the State of Wyoming:
a. Lot 3, Block 18 of the Original Town of Cokeville, Lincoln County,
Wyoming, together with all improvements thereon situated, also known as
215 Sage Street, Cokeville, Wyoming; and
b. The mineral interests described on Exhibit A attached hereto. After a
careful review of the legal descriptions of the mineral interests filed
with the Court in this matter, it was determined that the correct legal
description of the mineral interests is as set forth in the revised Exhibit
A attached hereto.
NOW, THEREFORE, IT IS ORDERED, ADJUDGED and DECREED that DR.
RICHARD E. DAYTON and ROBERT M. DAYTON are entitled to payment or delivery of all
of the Decedent's property described herein, including the property described on Exhibit A
attached hereto.
