A twenty -five year lease renewal is hereby offered, subject to the terms and conditions specified in the enclosed lease forms. If you concur, please sign the back of the enclosed lease form and the commitment form, and return both copies of each (with the stipulations) within thirty (30) days of receipt of this decision. A copy of the executed lease will be returned to you. This decision renews the lease and allows the operation of the ski area at its current level of development. The remaining actions requested in your application, such as receiving the option to purchase, expansion of the ski area, and changing the plan of development (to include a new ski lift and ski runs), will be addressed in another decision. Final adjudication of your application can proceed after we receive a concurrence letter from the U.S. Fish and Wildlife Service (concerning our Biological Assessment on the Lynx), and after we receive an updated and perfected Plan of Development and Management from the County Planning Department. 'There are reserved to the United States all mineral deposits in said lands, together with the right to mine and remove the same under applicable laws and regulations to be established by the Secretary of the Interior. (2) If the lessee or his (its) successor in interest does not comply with the terms or provisions of Title VI of the Civil Rights Act of 1964, and the requirements imposed by the Department of the Interior issued pursuant to that title, during the period during which the property described herein is used for the purpose for which the lease was made pursuant to the act cited above, or for another purpose involving the provision of similar services or benefits, the Secretary of the Interior or his delegate may declare the terms of this lease terminated in whole or in part. (3) The lessee, by acceptance of this lease, agrees for himself (itself) or his (its) successors in interest that a declaration of termination in whole or in part of this lease shall, at the option of the Secretary or his delegate, operate to revert in the United States full title to the lands involved in the declaration. (4) The United States shall have the right to seek judicial enforcement of the requirements of Title VI of the Civil Rights Act of 1964, and the terms and conditions of the regulations, as modified or amended, of the Secretary of the Interior issued pursuant to said Title VI, in the event of their violation by the lessee. (5) The lessee or his (its) successor in interest will, upon request of the Secretary of the Interior or his delegate, post and maintain on the property conveyed by this document signs and posters bearing a legend concerning the applicability of Title VI of the Civil Rights Act of 1964 to the area or facility conveyed. (6) The reservations, conditions, and limitations contained in paragraphs (I) through (5) shall constitute a Covenant running with the land, binding on the lessee and his (its) successors in interest for the period for which the land described herein is used for the purpose for which this lease was made, or for another purpose involving the provision of similar services or benefits. (7) The assurances and covenant required by sections (1) -(6) above shall not apply to ultimate beneficiaries under the program for which this lease is made. Debris from trees that are presently lying adjacent to existing. ski runs, and any other debris from trees resulting from construction activity on the lease area, will be disposed of by a method approved by the Kemmerer Field Manager, or his representative. 11. Ski runs that are developed as a result of timber removal shall be groomed and seeded. All logs, stumps and brush that will protrude through the snow and be a hazard to skiers will be removed from the ski run. 12. A trash collector device will be installed in the bed of the intermittent stream that is associated with the Coyote Draw ski run to catch sediment and trash resulting from the logging operation. The trash collector shall be of a design approved by the Kemmerer Field Manager. B. Lift and Tow Construction C. Building and Utility Construction 37f) 1. All uphill facilities shall be designed, constructed, operated, inspected, and maintained in accordance with the current American National Standard Safety Requirements for Aerial Passenger Tramways. Plans must be approved by the Kemmerer Field Manager. Prior to construction of any uphill system, the lessee shall submit to the Kemmerer Field Manager, an accurate ground profile and snow profile map scaled not smaller than one hundred (100) feet equals one (1) inch horizontally and forty (40) feet equals one (1) inch vertically. The map shall show all tower locations and the cable profiles. 2. All lifts and tows installed on the lease must be constructed under the supervision of an engineer who is qualified, as defined by the current American National Standard Safety Requirements for Aerial Passenger Tramways, to provide such supervision. The engineer shall certify in writing that all improvements and construction have been installed in accordance with approved plans. The lessee shall bear the cost of engineering and supervision services. The lessee shall not operate the facilities for public purposes until written approval is granted by the Kemmerer Field Manager. 1. All plans and specifications for building shall be prepared by an architect licensed in the State. The plans shall be in accordance with the National Building Code. Building plumbing shall be in accordance with the National Plumbing Code. The electrical system shall be in accordance with the National Electrical Code. Other systems shall be designed in accordance with recognized standards. Plans shall be submitted to the Kemmerer Field Manager for approval prior to beginning of construction. The lessee shall submit to the Kemmerer Field Manager, a Certification by the architect or engineer, who inspected construction, that the building has been constructed in accordance with the approved plans, before the building is approved for use. D. Operation and Maintenance 1. Snow removal on the access road to the area and in parking areas will be the responsibility of the lessee. Snow removal will be done in such a manner that it does not destroy or damage existing vegetation along the roadway. Snow will not be pushed into Pine Creek. 2. The operation and maintenance of all sanitation, food service and water supply operations, systems, and facilities shall comply with the standards of the local department of health and the United States Public Health Service. All sanitation facilities shall be of sealed -type construction. 3. Not later than November 1 of each year, the lessee shall have the lifts and ski tows inspected by an engineer who is qualified, as defined by the current American National Standard Safety Requirements for Aerial Passenger Tramways, to make such inspections.
