JENKINS, husband and wife, Grantors, of P.O. Box 172, Freedom, Wyoming 83120, for and in consideration of TEN DOLLARS ($10.00) and other valuable consideration, in hand paid, receipt of which is hereby acknowledged, CONVEY AND WARRANT to and STRAWBERRY HILLS, LLC, a Wyoming limited liability company, of P.O. Box 4234, Bedford, Wyoming 83112, and CHARLES E. WADE and BETTY G. WADE, husband and wife, of 8269 Gulf Blvd. #1301, Navarre Beach, Florida 32566, Grantees, a 60 foot wide perpetual right -of -way easement on the following described real estate situate in the County of Lincoln, State of Wyoming, for the following purposes and under the following conditions: 1. Land Encumbered by Easement. Grantors' land, encumbered by this easement, is described as follows: Lot 3 of Section 31, T34N, R1 18W, 6th P.M., Lincoln County, Wyoming. 2. Description of Easement. The easement area is described in Exhibit A, which is attached hereto, and incorporated herein by reference. 3. Purpose of Easement. This easement shall be for the purpose of providing a perpetual sixty -foot (60') wide right -of -way easement for ingress, egress, and underground utilities to the properties identified in Paragraphs land 4. 4. Property Benefited by Easement. The easement is for the benefit of the properties identified in Paragraph 1, and described in Exhibit B, attached hereto, and incorporated herein by reference. Except as provided in any easements of record prior to this easement, and as otherwise provide herein, this easement may not be used for access to any other property without a written easement authorizing such use, granted by both Grantors, or their successors or assigns, and Grantees, or their successors or assigns. f. Notwithstanding the above condition in Subparagraph e, Grantors and /or Grantees may petition a legal authority to make the right -of -way a public road, and Grantors and Grantees hereby consent to such petition. 6. Use of Easement for Access to Additional Land. If Grantees, or their successors and assigns, pay to Grantors, or their successors or assigns, Four Thousand Dollars ($4,000.00), Grantees, or their successors and assigns shall have the right to use the easement for ingress and egress and utilities to an approximately 60 -acre tract of land adjacent to the properties described in Paragraph 4, said tract being more particularly described as follows: The NE1 /4NW1 /4 and the N1 /2SE1 /4NW1 /4 of Section 6, T33N, R118W, 6th P.M., Lincoln County, Wyoming. 7. Binding Effect. This easement shall be binding upon and shall inure to the benefit of the heirs, successors in interest, and assigns of the parties named herein. 8. Waiver of Homestead Rights. The Grantors hereby waive and release all rights to the described easement under and by virtue of the homestead exemption laws of the State of Wyoming.
