Box 677, Afton, Wyoming 83110, ANDREW MOYER and JULIE MOYER, husband and wife, as tenants by the entireties, P.O. Box 97, Auburn, Wyoming 83111, and WADE W. DUNLAP and JILL DUNLAP, husband and wife, P.O. Box 1341, Afton, Wyoming 83110, GRANTEES, the following described non- exclusive, perpetual right -of -way easement for the following purposes: 1. PURPOSE OF EASEMENT. This easement is for the purpose of providing a perpetual, non exclusive right -of -way easement for ingress and egress and all underground utilities to the property described in Paragraph 3 including the right to install, construct, reconstruct, repair, replace, and maintain a roadway and all underground utilities, and including the right to inspect the easement. This easement is not for the purpose of providing or creating a public right -of -way or access to any public lands. 2. CONDITIONS OF EASEMENT. The conditions of this easement are: EASEMENT DOHERTY, TRUSTEE, ET AL. ROBINSON, TRUSTEES, ET AL. PAGE 1 OF 9 O 4( a. It is a common easement for the mutual benefit of all Grantees and their respective lands. b. If any Grantee disturbs the existing road through use of, construction on, or installation in the road, that Grantee shall upon completion of such use, construction, or installation, immediately return the road to its previous condition. c. Grantees shall be responsible for and pay all costs of maintaining the portion of the easement which the Grantee must cross to reach Grantee's property. In the event that multiple Grantees are responsible for the cost to maintain the easement, the costs shall be divided equally among those Grantees. d. All utilities installed in the easement by Grantees shall be underground. e. Grantees shall hold Grantors harmless from any liability, injury, damage, or claim by any person using or traveling upon the roadway, whether or not such use is with or without the permission, consent, or knowledge of the Grantees. 3. PROPERTY BENEFITTED BY EASEMENT. This easement is for the benefit of the following described real property of the Grantees: a. That property owned by Alvin L. Robinson and Alice L. Robinson, Trustees of the Alvin and Alice Robinson Family Trust dated April 10, 1997, as to an undivided 50% interest, and Lance P. Robinson and Melanie Robinson, Trustees of the Lance P. Robinson and Melanie Robinson Family Trust dated March 29, 2011, as to an undivided 50% interest, that is described in the Warranty Deed that was recorded in the land records of Lincoln County, Wyoming on October 27, 2011 in Book 775 at Pages 254 and 255 as Receiving No. 961619, a copy of which is attached hereto. b. That property owned by Andrew Moyer and Julie Moyer, husband and wife, that is described in the Warranty Deed that was recorded in the land records of Lincoln County, Wyoming, on March 1, 2006 in Book 613 at Page 542 as Receiving No. 916366, a copy of which is attached hereto. c. That property owned by Wade W. Dunlap and Jill Dunlap, husband and wife, that is described in the Warranty Deed that was recorded in the land records of Lincoln County, Wyoming on October 27, 2012 in Book 775 at Page 256 as Receiving No. 961620, a copy of which is attached hereto. 4. DESCRIPTION OF EASEMENT. The easement shall encumber: a. A portion of that property owned by Susan S. Doherty, Trustee of the Exemption Trust established under The Doherty Family Revocable Trust dated May 14, 1998, that is described in the Quitclaim Deed that was recorded in the land records of Lincoln County, Wyoming, on November 13, 2012 in Book 798 at Pages 21 through 24 as Receiving No. 967903, a copy of which is attached hereto. b. The easement is more particularly described in the "DESCRIPTION FOR EXEMPTION TRUST ESTABLISHED UNDER THE DOHERTY FAMILY REVOCABLE TRUST, DATED 14 MAY 1998 BIG RIDGE ROAD TRACT ADJUSTED which is attached hereto. 5. EASEMENT TO RUN WITH THE LAND. The easement created herein shall run with the lands identified herein, and shall be binding on and shall inure to the benefit of the parties to this Agreement, and their respective successors and assigns. 6. ENTIRE AGREEMENT. This Agreement constitutes the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding except to the extent incorporated in this Agreement. Any modification of this Agreement shall be binding only if evidenced by agreement in writing signed by the parties hereto or their heirs and successors and assigns. 8. WAIVERS. The failure of any party to this Agreement to enforce the performance of the terms and conditions set forth herein, or a waiver of a breach of any of the terms and conditions set forth herein, shall not be construed as a continuing waiver of such failure or breach, and the terms and conditions shall remain in full force and effect as if no such forbearance or waiver had occurred. 9. WAIVER OF HOMESTEAD RIGHTS. The parties, for themselves and their successors and assigns, hereby waive any and all rights under and by virtue of the homestead exemption laws of the State of Wyoming to the extent that such rights may interfere with the purposes of the easement. 10. ATTORNEY'S FEES. The parties agree that should any litigation be commenced between the parties concerning this Agreement, or the rights and/or duties of them in relation thereto, including any action to collect sums due hereunder, the party prevailing in such litigation shall be entitled to a reasonable sum for attorney's fees.
