The undersigned, Gerald L. Goulding, first being duly sworn and put upon his oath states as
1. I am an attorney duly licensed to practice law in the State of Wyoming, Attorney No.
5 -1637, with principal place of business located at 424 Adams Street, Afton, Wyoming, 83110, and
have in fact engaged in the practice of law at that location since 1978.
2. I represented the mortgagee in connection with that certain Mortgage between Alan
C. Jensen as mortgagor, and Ross A. Nield and Mable H. Nield, Trustees of the Ross A. Nield and
Mable H. Nield Charitable Remainder Unitrust dated February 20, 1998, as mortgagee, dated
September 14, 1998, and recorded in the office of the Lincoln County Clerk on September 16,
1998, in Book 417 PR, page 423, Receiving No. 853355 "the mortgage
3. On or about May 13, 1999, Mable H. Nield came to my office and informed me that
the mortgagor had paid off the mortgage indebtedness in full and requested that I prepare for the
signatures of the trustees a release of the mortgage in recordable form.
4. I subsequently prepared a Release of Real Estate of Mortgage for the mortgage
which was duly executed by Ross A. Nield and Mable H. Nield for the mortgagee and delivered the
original of said release to Mable H. Nield for delivery to the mortgagor.
5. Attached hereto and incorporated herein by this reference is a true, complete, and
correct copy of the Release of Real Estate Mortgage.
6. I have been .recently informed that the original Release of Real Estate Mortgage has
not been recorded and cannot by the exercise of reasonable diligence be found.

7. Based on the foregoing and upon information and belief, I believe that mortgagee
intended to release the mortgage on May 13, 1999, because mortgagor had paid the indebtedness
in full.

RELEASE OF REAL ESTATE MORTGAGE
KNOW ALL MEN BY THESE PRESENTS, that Ross A. Nield and Male H. Nield,
husband and wife, and as Trustees of the Ross A. Nield an Mable H. Nield Charitable
Remainder Unitrust dated February 20, 1998, of Afton, Lincoln County, Wyoming (mailing
address: PO Box 256, Afton, WY 83110) do hereby certify that a certain mortgage
bearing the date of September 12, 1998, made and executed by Alan C. Jensen, a single
man, of Salt Lake City, Salt Lake County, Utah (mailing address: 7774 Brighton Cove, Salt
Lake City, UT 84121), mortgagor, conveying certain real estate therein mentioned as
security for the payment of $180,000.00 as therein stated, which mortgage was recorded in
the Office of the County Clerk and Ex- Officio Register of Deeds of Lincoln County, State of
Wyoming, on the 16th day of September, 1998, in Book 417 PR, page 423; mortgaging the
following described real estate in said County, to -wit:
ALL LANDS DESCRIBED IN SAID MORTGAGE
is, with a note secured thereby, and the aforementioned debt, fully paid, satisfied, released,
and discharged; and in consideration thereof the said mortgagees do hereby release and
quitclaim unto the said mortgagor the premises thereby conveyed and mortgaged.
