Box 7000 Jackson, Wy 83002 Property Tax ID: 3519- 021 -00- 438.00 Reference 247062513 Order 7910600n SUBORDINATION AGREEMENT SEE COMPLETE LEGAL ATTACHED AS EXHIBIT "A" Commonly Known As: 700 Rock Farm Road, Etna, WY 83118 RECEIVED 8/28/2013 at 10:49 AM RECEIVING 972932 BOOK: 818 PAGE: 867 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY THIS INDENTURE, made this 23rd day of August 2013 between BANK OF JACKSON HOLE, hereinafter called party of the First Part, and BANK OF AMERICA, N.A., hereinafter called Party of the Second Part, WITNESSETH, that whereas the Party of the First Part is the owner and holder of a certain Mortgage taken out by STEPHEN JUDGE and PATRICIA C JUDGE, in the original principal indebtedness of $60,000.00, which Mortgage was recorded on 01/31/2008, in Book 685PR, Page 364; encumbering the land situate in the County of Lincoln, Wyoming, described as follows: AND WHEREAS, STEPHEN JUDGE and PATRICIA C JUDGE, have made application to the Party of the Second Part for a loan to BANK OF AMERICA, N.A., in the amount not to exceed $92,000.00, to be secured by a First Mortgage encumbering the above described premises, and Party of the Second Part has required as a condition precedent to making of said loan that the Party of the First Part subordinate its Mortgage and the lien thereof and all of its rights there under to the Mortgage to be placed upon said premises as aforesaid, and Party of the First Part is agreeable to such subordination. 0807 NOW THEREFORE, in consideration of the sum of One Dollar ($1.00), and other valuable consideration in hand paid by the Party of the Second Part to the Party of the First Part, receipt whereof is hereby acknowledged, and as inducement for making the aforesaid loan by the Party of the Second Part to the aforesaid STEPHEN JUDGE and PATRICIA C JUDGE, the Party of The First Part does hereby subordinate the aforesaid Mortgage by it and the lien thereof and all of its rights and there under to the Mortgage recorded in Official Records, BookB Page6Cfl q 1Z. or Document Number 0��� of the Public Records of Lincoln County, Wyoming, encumbering the above described premises and does hereby covenant with the Party of the Second Part that it has not transferred or assigned the aforesaid Mortgage held by it, nor the Promissory Note it secures, nor any interest held by it in either of said instruments, and it executed this Subordination Agreement as sole owner of the entire interest held by it in said Note and Mortgage and declare any right or claim held by it to be subject and inferior to the Mortgage held by the Party of the Second Part and to all rights of the Party of the Second Part there under. 0868 IN WITNESS WHEREOF, THE PARTY OF THE FIRST PART HAS HEREUNTO SET ITS HAND AND SEAL ON THE DAY AND YEAR FIRST WRITTEN.
