Now on this day, this action being brought by the Petition filed by the
Plaintiffs, G. Nohl Sandall and Vickie M. Sandall, Rod R. Jensen and Ileene C.
Jensen Joint Living Trust, Dated 28 Feb 2008, Leo H. Putnam and Shirley K.
Putnam, appearing by Spencer L. Allred of Bowers Law Firm, P.C., their attorney,:
the Defendants not appearing, either in person or by counsel, in the time allowed by
law, and it appearing to this court that the other Defendants have been regularly
and duly served with the petition and summons by publication in the Star Valley
Independent, a weekly newspaper, published in Afton, Wyoming, and that a copy of
the Notice of Suit was not mailed to the Defendants because they have no known
address and addresses for Defendants cannot with reasonable diligence be
ascertained, that the time allowed by law for answering or otherwise pleading has
expired as of the 19th day of March, 2013 and the default of the other Defendants is
hereby duly entered, according to law; and the Court having examined the record
and proofs offered herein, and having fully considered the same, and having found
that the allegations of the Plaintiff's Complaint are all true, therefore, by reason of
the foregoing facts, and by virtue of law:
IT IS HEREBY ORDERED, ADJUDGED and DECREED that the Plaintiffs,
G. Nohl Sandall and Vickie M. Sandall, owns and is in possession of, and at the
commencement of this suit owned and was in possession of the following real
property situate in the County of Lincoln, State of Wyoming:
PARCEL 1
County in Book 9 of Deeds on page 195, in Book 117 of Photostatic
Records on page 2, in Book 440 of Photostatic Records on page 722, and
in Book 533 of Photostatic Records on page 119.
IT IS FURTHER ORDERED, ADJUDGED and DECREED that the
Plaintiffs, Rod R. Jensen and Ileene C. Jensen Joint Living Trust, Dated 28 Feb
2008, owns and is in possession of, and at the commencement of this suit owned and
was in possession of the following real property situate in the County of Lincoln,
State of Wyoming:
PARCEL 2
Lot 1 of Block 3 of the Town of Afton, Lincoln County, Wyoming, being
part of that tract of record in the Office of the Clerk of Lincoln County
in Book 441 of Photostatic Records on page 718, and part of that tract
of record in said Office in Book 589 of Photostatic Records on page 119
and all of that tract of record in said Office in Book 689 of Photostatic
Records on page 45, it being the intent to more correctly describe said
tract in Book 689.
IT IS FURTHER ORDERED, ADJUDGED and DECREED that the
Plaintiffs, Leo H. Putnam and Shirley K. Putnam, owns and is in possession of, and
at the commencement of this suit owned and was in possession of the following real
property situate in the County of Lincoln, State of Wyoming:
PARCEL 3
That part of Lot 4 of Block 3 of the Original Townsite of Afton within
Section 30, T32N R118W, Lincoln County, Wyoming, being part of
those tracts of record in the Office of the Clerk of Lincoln County in
Book 9 of Deeds on page 195, in Book 101 of Photostatic Records on
page 379, in Book 117 of Photostatic Records on page 2, and in Book
440 of Photostatic Records on page 722.
IT IS FURTHER ORDERED, ADJUDGED and DECREED that the
Defendants are found to have no right, title, interest, claim, or demand in the
above described real property; that the Defendants are hereby forever barred from
asserting any right, title, interest, claim, or demand thereto, and title thereto is
quieted in the Plaintiffs in accordance with this order.
