The second party is selling and conveying to the first party approximately eighty acres (80) near Thayne, County of Lincoln, State of Wyoming described in "Exhibit A The Eastemly portion of the approximate eighty acre (80) parcel shall be conveyed to the first party by the second party in a fee simple conveyance. The remaining Westerly forty acres (40) described in "Exhibit 8 of the eighty acre (80) parcel described will be subject to a promissory note and mortgage containing terms of payment from the first party to the second party. B. In addition to the eighty acres described in paragraph A, Maria Mary Eggleston Lovelady and Kent Lovelady own an adjacent piece of real estate in which the easement is to cross over. The In Gross portion of this easement shall only be valid so long as Kim Eggleston, Raedene Eggleston, Valdean Wayne Eggleston, Sandra Eggleston, Mary Eggleston Lovelady, Kent Lovelady, Aneta Regina Burton, Kay Burton Julie Ann Harmon and Robert Harmon have a mortgage or other interest in the real property described in "Exhibit B hereto attached. At such time that any and all mortgages are released by the second party, involving the real estate described in "Exhibit B" then the In Gross portion of this easement shall terminate immediately. CONSIDERA The first party, second party and third party have entered into certain real estate transactions, in which the first party is purchasing from the second and third party certain real estate located near Thayne Wyoming. The first party, second party and third party by their signature and execution of this document hereby state and declare that they have received consideration for this easement and it shall not be invalid for lack of consideration. The forth party states that they have received consideration in the amount of $2,500.00 and the right to use this easement (which runs with the real property). All parties state and declare they have received valuable consideration for this agreement. EASEMENT NOT TO BE OBSTRUCTED The first party, second party, third party and fourth party shall use the rights granted by this instrument, with due regard to the rights of the other parties, their heirs and assigns and shall not use the easement in any way which will impair the rights of the other parties to this agreement. In contemplation of this easement the parties agree and state that their intent is that this easement will provide "reasonable use" to the benefit of the parties to this easement.
