HomeMy WebLinkAbout973230AMENDED SHERIFF'S DEED THIS INDENTURE made this /day o- r 2013, between the Sheriff of Lincoln County, Wyoming and 2010 -1 RADC /CADC Property XV, LLC, a Delaware limited liability company (the "Purchaser WHEREAS, on the 2 "d day of April, 2013, at the hour of 10:00 a.m. at the front door of the Lincoln County Courthouse in Kemmerer, Wyoming, the Sheriff did at that time hold and conduct a sale of the following described property: Lot 156 ofNordic Ranches Division No. 11, 2 Filing, Lincoln County, Wyoming according to that plat filed May 24, 2007 as Receiving No. 929684. The Real Property or its address is commonly known as 120 Pony Circle, Etna, Wyoming 83118. The Real Property Assessors Parcel or tax identification number is 12- 3619- 26 -4 -00- 280.00. WHEREAS, said sale was held pursuant to the power of sale contained in the following mortgage: (i) Construction Mortgage (the "Mortgage dated May 23, 2007, executed and delivered by Jeffrey Tibbitts, a single man "Mortgagor to First Bank of Idaho, fsb, dba First Bank of the Tetons, "Original Mortgagee which Mortgage was executed and delivered by said Mortgagor, to said Original Mortgagee, and which Mortgage was recorded on May 30, 2007, in Book 659PR, page 785 in the records of the office of the Clerk in and for Lincoln County, State of Wyoming; (ii) Modification of Mortgage dated August 2, 2007 "First fr ill Modification executed and delivered by Mortgagor to Original Q w w and which First Modification was recorded on August 13, N 2007, in Book 668PR, page 624 in the records of the Office of the Clerk a) c W z w in and for Lincoln County, State of Wyoming; and (iii) Modification of Mel 0 Q Y Mortgage dated February 1, 2010 "Second Modification executed N a) a w and delivered by Mortgagor to the Federal Deposit Insurance M z v Corporation as Receiver for the Original Mortgagee and which Second a 0 Q Modification was recorded on February 26, 2010, in Book 743PR, page W 5 N 108 in the records of the Office of the Clerk in and for Lincoln County, 0 Y v State of Wyoming. W w 0 z CO 0 Assignment of Mortgage by the Federal Deposit Insurance Corporation Ct Z as Receiver for First Bank of Idaho, FSB dba First Bank of the Tetons unto 2010 -1 RADC /CADC Venture, LLC, a Delaware limited liability company, its successors and assigns, executed on September 1, 2010, Page 1 of 3 AMENDED SHERIFF'S DEED O" effective as of August 26, 2010, and recorded on November 29, 2010, and Book 757PR, page 792 in the records of the office of the Lincoln County Clerk in and for Lincoln County, State of Wyoming 83128. WHEREAS, Notice of Foreclosure Sale was published four (4) times in The Kemmerer Gazette, a newspaper of general circulation within and for Lincoln County, Wyoming, on March 7, 2013, March 14, 2013, March 21, 2013 and March 28, 2013. WHEREAS, pursuant to the Notice of Foreclosure Sale, the Sheriff did at the time and place therein set and appointed exposed for sale and did sell at public auction the above described property lying within Lincoln County, Wyoming. WHEREAS, the premises were sold at the time and place fixed for sale and offered for sale at public auction to the highest bidder. The property was sold to 2010 -1 RADC /CADC Venture, LLC, the highest bidder, for the sum of $265,000.00, the highest bid. WHEREAS, on March 2, 2013, the Sheriff executed a Certificate of Sale which was recorded on April 3, 2013, as Lincoln County Recorder's Instrument No. 970316 Book 808 of Photos page 407. WHEREAS, on April 23, 2013, 2010 -1 RADC /CADC Venture, LLC did assign the Certificate of Sale and its right of receipt of this Sheriff's Deed to 2010 -1 RADC /CADC Property XV, LLC (the "Purchaser pursuant to an Assignment of Certificate of Sale and of Right to Receipt of Sheriff's Deed which was recorded on May 2, 2013, as Lincoln County Recorder's Instrument No. 970783 Book 810 of Photos page 548. NOW, THEREFORE, know all men by this deed that I, Shane Johnson, Sheriff of the County of Lincoln in consideration of the premises, have granted and sold and do hereby convey to the Purchaser, its successors and assigns, the following described real property: Lot 156 ofNordic Ranches Division No. 11, 2 Filing, Lincoln County, Wyoming according to that plat filed May 24, 2007 as Receiving No. 929684. The Real Property or its address is commonly known as 120 Pony Circle, Etna, Wyoming 83118. The Real Property Assessors Parcel or tax identification number is 12- 3619- 26 -4 -00- 280.00. to have and to hold the described premises with all appurtenances to said Purchaser, its successors and assigns forever.
