PAYMENT shall be due in the following manner:
1. The sum of FIFTEEN THOUSAND ($15,000Q) DOLLARS as a down
payment is acknowledged by the Sellers as paid.
2. The principal sum of FIFTEEN THOUSAND ($15,000K) DOLLARS
and NO /100 interest free being due and payable on the 1st day of July,
2002.
3. Extra payments may be made for the purpose of reducing the principal
debt owed at any time, without prior approval of the Sellers, with no
prepayment penalty.
4. Time is of the essence in this contract and the holder may, at their
option, declare the entire balance of said debt and the interest thereon,
due and collectible in the event of default in payment of any
installment for a period of ninety (90) days, after the same shall be
paid. In the event of default in payment of this note or any part thereof
within the terms previously described and the same is placed in the
hands of an attorney for collection, Buyers agree to pay all costs of
collection, including any reasonable attorney fees.
Buyers have taken possession of said property as of July 1, 2000.
Parties acknowledge that he said real property described herein is not
mortgaged at the time of this Agreement. It is further acknowledged that
marketable title was intact and the Sellers had full right to sell the real property,
which they have freely done, having made proper conveyance to Buyers by deed.
There shall be no third party escrow agent on this contract unless, at some
future time, one is appointed by the Sellers with approval of the Buyers.
Sellers shall be provided a Promissory Note for the unpaid $15,000 from
the Buyers accompanied with a Mortgage to the Sellers for security of the
payments. Sellers may record the same if they so desire. The drafter of the
mortgage encourages the recording on the public records of the County. Parties
