3. Validity and Effect of Mortgage. The parties hereto intend this agreement only to
modify the promissory note and mortgage referred to herein and do not intend that a new mortgage
be created hereby. Mortgagor covenants that the mortgage is a valid first lien on the mortgaged
premises; that the priority of the mortgage is not affected hereby; and that there are no defenses or
offsets to such mortgage as modified hereby.
All of the terms, covenants and conditions of the mortgage, except as herein modified,
shall remain in full force and effect and are hereby ratified and confirmed.
4. Binding Effect. This agreement shall be binding upon and inure to the benefit of the
parties hereto, their heirs, successors, representatives and assigns.

year first above written.
