1. Water Rights. Lambert shall acquire ground water rights from
the State Engineer's Office for the location and use of a water well on her Lot 24.
Lambert shall grant Long the right to use the ground water on the same basis as
the permittee.
2. Water Well And Pipeline Easement. The water well shall be
located on that portion of Lot 24 as described on the attached Exhibit A, which
description shall include the pipeline running to Long's Lot 25. Lambert grants
to Long an easement for the well and pipeline as shown on the attached Exhibit
A. The purpose of the easement shall include the right to install, construct,
reconstruct, replace, inspect, maintain, operate, improve and locate a water well
together with necessary pipeline with incidental appurtenances, connections,
and structures in, on and under the easement area.
3. Septic System And Pipeline Easement. The septic system
shall be located on that portion of Lot 25 as described on the attached Exhibit B,
which description shall include the pipeline running to Lambert's Lot 24. Long
grants to Lambert an easement for the septic and pipeline as shown on the
attached Exhibit B. The purpose of the easement shall include the right to install,
construct, reconstruct, replace, inspect, maintain, operate, improve and locate a
septic system together with necessary pipeline with incidental appurtenances,
connections, and structures in, on and under the easement area.
4. The parties will keep their respective easement area clear of trees
and structures that could interfere with the intended use. of the easement and
each of the parties will use reasonable care to restore the subject properties to the
approximate condition and elevation that existed prior to construction and
maintenance. The water well easement and the septic easement shall be
appurtenant to and for the benefit of both properties and shall be binding upon

a manner that is in compliance with good engineering practices then prevailing
in Lincoln County, Wyoming and with all laws, ordinances, codes and
regulations of governmental agencies having jurisdiction.
8. Maintenance And Costs Of The Septic System. The
parties shall equally share all costs in the operation of the septic system including
but not limited to construction costs, casing, pumps, transmission lines, and all
other costs customarily associated with a septic system. The parties shall each be
responsible for the costs of their respective transmission line from the septic to
their residence together with their respective location and construction of such
transmission line. Either party shall have the right to cause any reasonably
necessary work on the septic system to be performed, in which event upon
receipt of request for payment or reimbursement accompanied by appropriate
invoices and back -up data, the other party shall pay directly to the vendor or
contractor or shall reimburse the paying party for their one -half share of the cost
of such work. If the party fails to make such payment or reimbursement as
contemplated herein within thirty days after receipt, then any amount advanced
by the other party and not so reimbursed, shall bear interest at the rate of twelve
percent per year until paid in full. All work and activities contemplated in this
Agreement shall be undertaken in a good and workmanlike manner utilizing
equipment and materials of good quality and condition and in a manner that is
in compliance with all laws, ordinances, codes and regulations of governmental
agencies having jurisdiction. The easement area and water well facilities shall be
kept at all times in good, clean and operating condition and state of repair and in
a manner that is in compliance with good engineering practices then prevailing
in Lincoln County, Wyoming and with all laws, ordinances, codes and
regulations of governmental agencies having jurisdiction.
