o oti d the Kastners sell, rent or default on their loan, payments for the one acre will
ontinue to the Kastners, for it will not affect the James' loan or the one acre, due to the
Kastners paying off the acre in full at the beginning of the James' loan, therefore the
James' interest is already protected.
If at some or any point in time between the next five (5) years before the second
mortgage is paid in full the James' feel that they can no longer make their payments for
any reason (including late payments of more then thirty (30) days to either investor, or
they just want to sell their home), before bankruptcy or default is an issue the James' are
obligated by their below signature to contact the Kastners. The Kastners will handle all
aspects of selling the James' home for them, including disbursement of funds, which
would be paid as follows: First Mortgage due on home, Second Mortgage due on home
(Kastners), agent fee, costs associated with sale. Any remainder left after this
disbursement would be split equally between the James' and the Kastners (the James'
amount will be short any penalty charge paid during disbursement to the first mortgage if
the loan is paid off before the probationary term with them is not satisfied). All
documents supporting the disbursement and distribution of the remainder of funds will be
given to the James'. If the amount collected does not cover the cure amount for the
Second Mortgage, any remainder due will still be paid by the James'.
The James' understand that this loan can not be remedied in any bankruptcy or
foreclosure. The amount will remain regardless if either of the James' file for bankruptcy
or default on their first mortgage.
If the James' decide to rent the modular and acreage out, rent payment from renters
should be the cost of the James' mortgages. Payments to the Kastners will continue as if
the James' were still on the property. If renter misses payments to the James', this will
not effect payment to the Kastners.

6. The acceptance of this Mortgage, and the note or notes it secures, by the Mortgagor
shall be an acceptance of the terms and conditions contained herein.
7. The covenants and agreements herein contained shall bind, and inure to the benefit
of, the respective heirs, devisees, legatees, executors, administrators, successors and assigns of the
Mortgagor and the Mortgagee. When ever used, the singular number shall include the plural, the
plural the singular, and the use of any gender shall include all genders.
8. The Mortgagor shall not create, incur or suffer to exist any other mortgage or lien
on the property which is not junior to the lien of this mortgage.
9. The Mortgagor shall not be entitled to set -off or any similar rights against any
amounts owed hereunder or under the note or notes secured hereby.
10. If all or any part of the real property or any interest therein (including any
partnership interest) is sold, conveyed (other than by lease), or otherwise transferred voluntarily or
involuntarily, without the express written consent of Mortgagee, all sums secured hereby shall be
immediately due and owing, and Mortgagee shall be entitled to all remedies provided by the terms
hereof and the Note, the same as if a default had occurred thereunder.
11. This Mortgage is executed by the spouse of each Mortgagor, if any.
12. If there is more than one holder of the note or notes secured hereby at any time, any
action with respect to the Mortgage by the holder or holders of 51% or more in unpaid principal
amount thereof shall be binding upon all other holders.
13. Each individual executing this Mortgage and the related note or notes shall be
personally bound, jointly and severally, to perform and observe all covenants and agreements of the
Mortgagor contained herein and therein.
14. Any notice required to be given to any person hereunder or under the note or notes
secured hereby shall be given by delivery or by mailing the same by certified mail to such person at
the address noted above (or to such other address as shall have been specified in writing), the notice
so mailed shall for all purposes hereof, be as effectual as though served upon such party in person
at the time of the depositing such notice in the mail.

acre of the Kastners portion of the land (7.5+ acres), and the one acre for the James' is
financed through the Kastners' financial institution.
Should the Kastners sell, rent or default on their loan, payments for the one acre will
continue to the Kastners, for it will not affect the James' loan or the one acre, due to the
Kastners paying off the acre in full at the beginning of the James' loan, therefore the
James' interest is already protected.
If at some or any point in time between the next five (5) years before the second
mortgage is paid in full the James' feel that they can no longer make their payments for
any reason (including late payments of more then thirty (30) days to either investor, or
they just want to sell their home), before bankruptcy or default is an issue the James' are
obligated by their below signature to contact the Kastners. The Kastners will handle all
aspects of selling the James' home for them, including disbursement of funds, which
would be paid as follows: First Mortgage due on home, Second Mortgage due on home
Kastners); agent fee, costs associated with sale. Any remainder left after this
disbursement would be split equally between the James' and the Kastners (the James'
amount will be short any penalty charge paid during disbursement to the first mortgage if
the loan is paid off before the probationary term with them is not satisfied). All
documents supporting the disbursement and distribution of the remainder of funds will be
given to the James'. If the amount collected does not cover the cure amount for the
Second Mortgage, any remainder due will still be paid by the James'.
The James' understand that this loan can not be remedied in any bankruptcy or
foreclosure. The amount will remain regardless if either of the James' file for bankruptcy
or default on their first mortgage.
If the James' decide to rent the modular and acreage out, rent payment from renters
should be the cost of the James' mortgages. Payments to the Kastners will continue as if
the James' were still on the property. If renter misses payments to the James', this will
not effect payment to the Kastners.
