operation, and continued maintenance of waterline(s), powerline(s), spring collection, and
related facilities over, under, and through the premises of the Grantor(s) in Lincoln County,
State of Wyoming, is more particularity described to wit:
Waterline, Access, and Utility Easement
A 35 foot wide permanent easement and 50 foot wide temporary construction
easement, the centerline of which is described as follows:
Commencing at the east quarter corner of Section 24, T34N, R119W, 6th P.M.,
Lincoln County, Wyoming; and running thence south 2,634.71 feet to the
southeast corner of said Section 24, which is the basis of bearing for this survey.
Thence N 76° 49' 01' W, 1.584.39 feet to a point on an existing fenceline, which
is the POINT OF BEGINNING;
Thence S 64° 11' 34" W, 383.46 feet;
Thence S 74° 42' 51" W, 232.92 feet;
Thence S 56° 15' 52" W, 72.24 feet;
Thence S 45° 29' 22 W, 77.16 feet;
Thence S 59° 20' 54" W, 94.79 feet;

EASEMENT CONDITIONS

1. The Town of Thayne will quit -claim those properties no longer required and as replaced
by this easement as described in that Right of Way Deed filed in Book 52 Page 491 in
the Lincoln County Recorders Office back to Earl Kinslow.
2. Access will be limited to the Town's employees and agents for the purposes of
constructing, operating, and maintaining the pipeline and spring site.
3. Spring site fencing will be field fencing. No chain Zink or other type fencing will be used
unless approved by Grantor.
4. Pipeline alignment will be restored to a condition equal to or better than existing
following pipeline excavation.
5. Spring collection and storage structures will be buried with only tops (lids) showing
above ground.
6. Grantor agrees to grant the Town of Thayne an access easement for construction of a
gravel roadway. Said easement will commence at the east quarter corner of Section
24, thence run south along the existing driveway to Grantor's residence, thence
southwesterly along the slope of an existing hillside to the spring site. The actual final
alignment of said access easement will be determined during construction based on
direct coordination with Grantor.
7. Town of Thayne agrees not to construct a permanent paved or graveled roadway in the
meadow area surrounding the spring site.
8. Town of Thayne acknowledges that grantor's plans to construct a single family
residence on the hill overlooking the spring site located approximately 1000 feet
northeast of the spring site. The town further agrees to the construction of a septic
system for a single-dwelling at that location. *.tp(• ll
