Turner and Marie E. Turner, shall have no obligation to pay for any
maintenance of the road until such time as they subdivide their land as
described below or build one or more residences on that property or
otherwise change its use so that they materially increase their use of the
road. Grantees agree to pay their reasonable and fair share of such
maintenance annually or at such other time as all of them agree. If any of
them fails to pay their reasonable and fair share, one or more of the others
may bring legal action pursuant to this Easement to compel such payment.
In any such legal action, the prevailing party may recover their reasonable
attorney fees and costs in addition to any other relief granted.
3 Property Benefited by Easement. This easement is for the benefit of the
following described real property of the grantees in Lincoln County, Wyoming:
Lloyd S. Heiner Revocable Trust
NE1 /4NE1/4 of Section 10 and NW1 /4NW1/4 of Section 11, T33N, R118W of
the 6 P.M., Lincoln County, Wyoming.
Gavlon G. Heiner and Kristi G. Heiner
SW1 /4SW1/4 of Section 2, SE1 /4SE1/4 of Section 3 and SW1 /4NE1/4 of
Section 10, T33N, R118W of the 6 P.M., Lincoln County, Wyoming.
James K. Noble
N1/2SE1/4NE1/4 of Section 10 and N1/2SW1/4NW1/4 of Section 11, T33N,
R118W of the 6 P.M., Lincoln County, Wyoming.
Allen C. Turner and Marie E. Turner
SW1 /4NW1/4 of Section 11 and SE1 /4NE1/4 of Section 10, T33N, R118W of
the 6 P.M., Lincoln County, Wyoming, excepting therefrom land conveyed to

BEGINNING at a spike on the north line of said NE'K, N89 39' -21 "E, 41.56 feet from the
