contemporaneously herewith delivers the original Promissory Note to
Assignee with full power and authority in the Assignee to hold and collect the
Promissory Note and to foreclose the Mortgage the same as if the Mortgagee
had been the original holder of the Promissory Note and the original
Mortgagee of the Mortgage.
SECTION TWO
MODIFICATION OF PAYMENT SCHEDULE
Mortgagor and Assignee agree that the payment schedule as set forth in
the Promissory Note and the Mortgage which secures it shall be modified to
reflect that instead of semi annual installments of principal and interest,
principal and interest installments will be due and payable on a monthly basis
in the amount of Six Hundred Thirty Three Dollars and Sixty Four Cents
($633.64) each such installments of principal and interest being due and payable
on the 1st day of each month through the 1st day of August, 2017 at which time
the entire remaining principal balance due, if any, together with all accrued and
unpaid interest and costs, if any, shall be due and payable concurrently with the
two hundred and fortieth (240) and final monthly installment.
SECTION THREE
MODIFICATION OF INTEREST RATE
In consideration of the mutual agreements set forth herein, both original
Mortgagor and Assignee agree that the Note and Mortgage shall be further
modified by decreasing the interest rate to eight and ninety six one hundredths
(8.96 per annum on the unpaid principal balance from July 1st, 1999 to
maturity, resulting in equal monthly installments of principal and interest in
the amount of Six Hundred Thirty Three Dollars and Sixty Four Cents ($633.64)
due and payable on the first day of each month in accordance with Section Two
of this Agreement.
SECTION FOUR
ACKNOWLEDGMENT OF ASSIGNMENT BY MORTGAGOR
Mortgagor hereby acknowledges the assignment from Mortgagee to
Assignee of all right, title and interest in the Note and Mortgage and agrees that
Mortgagor will continue to make the payments on the schedule set forth
herein to Assignee at the following address:
