HomeMy WebLinkAbout974488RATIFICATION OF EASEMENT AGREEMENT RECEIVED 12/12/2013 at 11:05 AM RECEIVING 974488 BOOK: 825 PAGE: 248 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY THIS RATIFICATION OF EASEMENT AGREEMENT, hereafter the "Agreement effective this ,f 4 h day of December, 2013, is made by WJW HOLDINGS WY, LLC, a Wyoming limited liability company, c/o P.O. Box 3309, Alpine, Wyoming 83128, ALPINE AIRPARK, LLC, a Wyoming limited liability company, c/o P.O. Box 3309, Alpine, Wyoming 83128, and THE BANK OF STAR VALLEY, organized and existing under the laws of the State of Wyoming, P.O. Box 8007, Afton, Wyoming 83110. WHEREAS, an Easement Agreement was entered into effective the 4th day of April, 2012 by various parties, said Easement Agreement being that which was recorded in the land records of Lincoln County, Wyoming on September 6, 2012 in Book 793 beginning at Page 451 as Receiving No. 966666; and WHEREAS, said Easement Agreement misstated that the owner of Lot 92, Alpine Village Subdivision No. 1, Plat 2 Amended, 10th Filing Amended, Accession No. 930105, was "WJW Holdings WY, LLLP, a North Dakota Limited Liability Partnership" when the owner was "WJW Holdings WY, LLC, a Wyoming limited liability company and WHEREAS, WJW Holdings WY, LLC has subsequently conveyed said Lot 92, Alpine Village Subdivision No. 1, Plat 2 Amended, 10th Filing Amended, Accession No. 930105, to Alpine Airpark, LLC through the Warranty Deed that was recorded in the land records of Lincoln County, Wyoming on September 30, 2013 in Book 821 at Page 419 as Receiving No. 973483; and WHEREAS, Alpine Airpark, LLC has subsequently mortgaged Lot 92, Alpine Village Subdivision No. 1, Plat 2 Amended, 10th Filing Amended, Accession No. 930105, to The Bank of Star Valley through the Mortgage that was recorded in the land records of Lincoln County, Wyoming on October 14, 2013 in Book 822 beginning at Page 298 as Receiving No. 973673; and WHEREAS, WJW Holdings WY, LLC, Alpine Airpark, LLC, and The Bank of Star Valley wish to ratify the Easement Agreement. RATIFICATION OF EASEMENT AGREEMENT PAGE 1 OF 5 NOW, THEREFORE, for good and valuable consideration, receipt of which is hereby acknowledged, WJW Holdings WY, LLC, Alpine Airpark, LLC, and The Bank of Star Valley, for themselves and their successors and assigns, hereby join in and ratify said Easement Agreement and agree that the terms and conditions therein shall hereafter apply to said Lot 92, Alpine Village Subdivision No. 1, Plat 2 Amended, 10th Filing Amended, Accession No. 930105. IN WITNESS WHEREOF, WJW Holdings WY, LLC, Alpine Airpark, LLC, and The Bank of Star Valley have caused this Agreement to be signed effective on the dates indicated above.
