I, Damien Mavis, being duly sworn on oath depose and state as follows:
1. I am the President of Covelop, Inc. a California corporation, which is the
manager of Alpine Development Group, LLC, a Wyoming Limited Liability Company.
2. Alpine Development Group, LLC is the owner of Lot 32 shown on the plat
entitled "Snake River Junction, Second Filing First Amended" subdivision "the Subdivision
which plat was recorded in the Office of the Lincoln County, Wyoming Clerk on April 19, 2010
as Document No. 952960 "the Plat
3. The Plat was prepared at Alpine Development Group, LLC's direction, and I
signed the Plat.
4. The "PLAT WARNING" portion of Plat erroneously omits reference to
contractual obligations of lot owners regarding water and sewer hook ups to water and sewer
infrastructure operated by North Star Utility, Inc., a Wyoming corporation. Specifically, pursuant
to a February, 2009 Amendment to Agreements for Water and Sewer (North Star Utility /Alpine
Development Group) "the Amended Agreement all undeveloped lots in the Subdivision are
required to have a restriction noted on the applicable plat mandating single family residential use
only (one (1) Sewer ERU per lot, one (1) Water ERU per lot subject to certain use restrictions set
forth in paragraph 3.c of said Amended Agreement), until that particular lot is re- platted either
for commercial or multi- family use and ERUs are calculated for such lot using agreed -upon
formulas set forth in the Amended Agreement.
5. Further, the "LAND USE TABLE" portion of the Plat incorrectly labels the new
lots numbers, and incorrectly refers to the underlying zoning of the lots. Specifically the
reference to "Lot 27" in the "LAND USE TABLE" should instead be "Lot 32. Further, Lot 32
should be designated "Single Family Residential Use Only" in order to comply with the
Amended Agreement provisions quoted in paragraph 4 above.
6. To correct the above errors, the Lincoln County, Wyoming Clerk is respectfully
requested to abstract this Affidavit under Lot 35 of the Snake River Junction, Second Filing
First Amended subdivision; and is further requested to mark upon the Plat in reproducible ink the
corrections noted in paragraphs 4 and 5 above, together with a reference to this Affidavit so that
anyone referencing the Plat will have notice of said corrections.
7. Information about agreements for water and sewer connections within the
Subdivision may be obtained by contacting Alpine Development Group, LLC at P.O. Box
12910, San Luis Obispo, CA 93406, or North Star Utility, Inc. at P.O. Box 610
Jackson, WY 83001.
8. This Affidavit is made pursuant to and in conformance with Wyoming Statutes,
34 -11 -101.
9. Further your Affiant sayeth naught.
