TODD E. HOOVER of 545 Cheyenne Dr., Suite A, Evanston, WY 82930, grantor, for and
in consideration of two thousand three hundred ($2,300.00) dollars and other good and valuable
consideration, in hand paid, receipt of which is hereby acknowledged, grants and conveys to THE
CITY OF KEMMERER, a Wyoming Municipality of 220 Wyoming Highway 233, Kemmerer,
State of Wyoming 83101, and its heirs and assigns, grantee, the following described, perpetual right
of -way easement for the following purposes and under the following conditions:
1. Purpose of Easement. This easement is for the purpose of providing a perpetual right -of-
way easement for use by the City slid members of the public for ingress, egress and parking
upon, along, and over the westerly twenty three (23.0) feet of the eastern most fifty (50.0)
feet of Lots 1 2, Block 7, of the Original Town of Kemmerer more specifically described
below in paragraph 3. Additionally, this easement is to allow the City to use said easement
for temporary staging and matters related to construction that occurs at the Old Kemmerer
City Hall building including but not limited to remodeling, adding to, and rehabilitation of
the building and parking lot construction.
2. Conditions of Easement. The conditions of this easement are:
a. The access provided by this easement is for the use of grantee, its agents and the
general public.
b. Grantor reserves the right to use two (2) arki g spaces in the finished parking lot on
an intermittent basis for not more than ours at any one time without charge.
c. Grantee shall grind out or otherwise remove the tree stumps and /or roots that are
located within the area of the easement without cost to grantor.
d. Grantee shall pave and generally maintain the parking lot. Such maintenance shall
include snow removal on a regular basis while the Old Kemmerer City Hall is
occupied or being used.
3. Property Benefited by Easement. This easement is for the benefit of the following
described real property of the grantee:
That entire portion of Lots 1 2, Block 7, of the Original Town of Kemmerer located to the
West and/or Southwest of the easterly fifty (50.0) feet of Lots 1 2, Block 7, of the Original
Town of Kemmerer, and more particularly described as follows:
Part of Lots 1 and 2 of Block 7 of the Original Town of Kemmerer
(now City of Kemmerer), Lincoln County, State of Wyoming,
described as follows: Beginning at a point on Sapphire Street on the
southerly line of said Lot 1, 50 feet westerly from the westerly line of
the alley in said block; thence westerly to the southwesterly corner of
said Lot 1; thence northerly on the westerly line of said Lots 1 and 2
to the northwesterly corner of said Lot 2; thence easterly on the
northerly line of said Lot 2 to a point 50 feet westerly of the westerly
line of said alley; thence southerly on a line parallel to and distant
westerly from said alley line 50 feet to the southerly line of said Lot
1, a distance of 100 feet, together with all building, improvements
and appurtenances thereon situate or in anywise appertaining thereto.
This property is that same property identified in the Warranty Deed from the Kemmerer
Diamondville Water and Wastewater Joint Powers Board to The City of Kemmerer dated
August 10, 2011 and recorded in the Office of the Lincoln County Clerk as instrument
number 960539 in Book 771PR at page 67 on the 12" day of August, 2011 with a commonly
known address of 700 Cedar Avenue, Kemmerer, WY.
4. Description of Easement. A temporary easement for construction and /or remodeling and
then a permanent easement for egress and ingress across and parking upon the westerly 23.0
feet of the easterly 50.0 feet of Lots 1 2, Block 7, of the Original Town of Kemmerer and
being more particularly described as follows:
Commencing at the southwest corner of Lot 1, Block 7, of the original Town of Kemmerer;

thence N63 °26'E along the southerly boundary line of said Lot 1, 89.60 feet, to the Point of
Beginning of this description said point being the monumented southwest corner of the
easterly 50.0 feet of said Lot 1 where is found a rebar with aluminum JFC survey cap.
Thence N26 °34'W along the monumented west line of the easterly 50 feet of Lots
1 2 of said Block 7, 100.0 feet to a point where is found an "X" chipped in the
concrete sidewalk representing the NW corner of said easterly 50 feet of said Lots 1
2 of said Block 7.
Thence N63 °26'E along the north boundary line of said Lot 2, 23.0 feet:
Thence S26 °34'E, 100.0 feet to a point on the south boundary line of said Lot 1;
Thence S63 °26'W along the south boundary line of said Lot 1, 23.0 feet to the point
of beginning.
Said easement containing 2300 square feet more or less and is shown on the map that is
identified as Exhibit 1, attached hereto, and made part of this easement by this reference.
5. Consideration. The consideration set forth above constitutes full and final payment for the
easement and right of way granted.
6. Binding Effect. The terms and conditions of this easement shall be binding upon and inure
to the benefit of the heirs, successors in interest and assigns of the parties named in this
instrument.
