THIS TRUST DEED is made MARCH 3, 2014, between
MOUNTAIN PRIME LLC as TRUSTOR, whose address is 3138 NORTH 1250 WEST PLEASANT VIEW UT 84414
BACKMAN TITLE SERVICES, LTD, as Trustee, and
FREEMONT INVESTMENTS LLC, as beneficiary.
TRUST DEED
Trustor hereby CONVEYS AND WARRANTS TO TRUSTEE IN TRUST, WITH POWER OF SALE, the following
described property situated in LINCOLN County, State of WYOMING.
A portion of dock 11 of Lincoln Heights 4th Subdivision to the Town of Kemmerer, Lincoln
County, Wyoming, as described on the official Plat No. 216 filed October 3, 1977 as Instrument
No. 499086 of the records of the Lincoln County Clerk, being more particularly described as
follows:
Beginning at the North radius point at the Southwest comer of said Block 11, then North
101 °0(Y00" West, along the West boundary of said Block 11, a distance of 593.58 feet;
Thence North 90 °00 East, a distance of 300.00 feet to a point on the East boundary of said:
Block 11;
Thence South 00 °00'00" West, along the East boundary of said Block 11, a distance of 618.44
feet to the point of curvature of a curve to the right;
Thence along the. arc of said curve to the right through a central angle of 110°00'00 a distance
of 34.91 feet, to the point of tangency, the radius of said curve being 2.0.00 feet;
Thence North 80°00 West, along the South boundary of said Block 11, a distance of 24.18
feet to the point of curvature of a curve to the left;
Thence along the arc of said curve to the Left through a central angle of 10 a distance of
233.87 feet to the point of tangency, the radius of said curve being 1340.00 feet, said point of
tangency also being the point of curvature of a curve to the right having a radius of 20.00 feet;
Thence along the ,arc of said curve to the Right through a central angle of 90 °00 a distance
of 31.42 feet to the point of binning.
Together with all buildings, fixtures and improvements thereon and all water rights, rights of way, easements, rents,
issues, profits, income, tenements, hereditament, privileges, and appurtenances thereunto used or enjoyed with said
property, or any part thereof;
FOR THE PURPOSE OF SECURING payment of the indebtedness evidenced by a promissory note of even date
herewith, in the principal sum of $188,000.00, payable to the order of the Beneficiary at the times, in the manner and
with interest as therein set forth, and payment of any sums expended or advanced by the Beneficiary to protect the
security hereof.
Trustor agrees to pay all taxes and assessments on the above property, to pay all charges and assessments on water
or water stock used on or with said property, not to commit waste, to maintain adequate fire insurance on improvements
on said property to pay all costs and expenses of collection (including Trustee's fees in event of default in payment of the
indebtedness secured hereby) and to pay reasonable Trustee's fees for any of the services performed by Trustee
hereunder, including a reconveyance hereof.
The undersigned Trustor requests that a copy of any notice of default and of ny no ce of sale hereunder be mailed
to him at the address hereinbefore set forth.
