Box 162, Cokeville, WY 83114, (Makers), promise to pay to the order of SHERILYN A. COATES, Trustee of the SHERILYN A. COATES REVOCABLE TRUST, dated April 14, 2009, of 120 3rd Street, Cokeville, Lincoln County, Wyoming P.O. Box 162, Cokeville, WY 83114 or its assigns (Holder), the sum of One Hundred Seventy -Nine Thousand Dollars ($179,000.00) 1. This Promissory Note (Note) shall bear interest at the rate of four point one -three percent (4.13 per annum. The term of the Note shall be thirty (30) years. 2. The Note shall be paid at the rate of Eight Hundred and Sixty -Eight Dollars and Four Cents ($868.04), principal and interest, per month, as calculated in the Amortization Schedule attached hereto, commencing June 1, 2014, and continuing on the same date of each succeeding month for three hundred and sixty (360) months. Makers shall have the option to make extra payments. Said payments shall be applied to the principal amount of this Note. Makers shall of the option of prepaying the entire amount of the balance due on this Note, at any time, without any penalty for prepayment. 3. Notwithstanding the terms of default outlined in Paragraph 4 of this Note, in the event of unemployment or serious illness of the Makers for a period of no more than six (6) months, the Holder shall not seek to foreclose on this Note and the corresponding Mortgage. HYMER PROMISSORY NOTE April 17, 2014 Page 1 of 3 Interest on the unpaid principal shall accrue during a period of unemployment or illness. Makers shall have one (1) year after the end of the six (6) month period to cure the default. In the event the Makers are unable to cure the default within the one (1) year period after the unemployment term, or if the term of unemployment or illness extends beyond a period of six (6) months, then the Holder shall have the right to foreclose on the Note and Mortgage in accordance with the terms of Paragraph 4 of this note and /or the terms outlined in the Mortgage. 4. Makers hereby also covenant, promise and agree that if, during the lifetime of the Holder, they should ever become divorced from one another, that such an event shall be deemed to be a default of the terms of this Note and Mortgage; and Makers shall be deemed to have forfeited and returned all legal interest in the real property and improvements to the Holder. Each Maker expressly agrees to waive all claim and interest in the property upon the occurrence of such a divorce, including all rights to payments that have been made under this Note and Mortgage. Each Maker also expressly agrees to further execute, at any time, all such documents or waivers that may be needed to make effective this provision. 5. In the event the Makers shall fail to pay any installment payment at the time the same is due, the whole of the principal sum then remaining unpaid, together with the interest that shall have accrued thereon, shall at the election of the holder of this note become at once due and payable. Notice of non payment, dishonor, demand, and protest shall be provided to the Makers at above address. The Holder shall of the right to foreclose on the Note and Mortgage according to the terms set forth herein and those terms contained within the Mortgage and Wyoming Statutes.
