JOHNSON, grantors of County of Lincoln, and State of Wyoming, hereafter referred to as GRANTORS, for and in consideration of TEN DOLLARS ($10.00) and other valuable consideration, in hand paid receipt of which is hereby acknowledged, CONVEY AND WARRANT to the Osmond Pipeline Company, of County of Lincoln, State of Wyoming, GRANTEE, an easement for the benefit of the GRANTEE, for the following purpose and under the following conditions: 1. Purpose of Easement. This perpetual easement and right of way shall be for the installation, maintenance replacement and repair of a culinary water line across the GRANTORS property described on the attached Exhibit A. This easement shall also allow for ingress and egress for maintenance and m co r �o z o n construction of the waterline. This easement shall allow GRANTEE to install o W Z and maintain line and require GRANTEE to reclaim and reseed disturbed area D w m z after construction activities. GRANTOR understands and agrees that said 73 61 m culinary water line installed under and across described lands shall remain the Z N N property of the grantee, removable at the sole discretion of the GRANTEE at n rn the GRANTEE'S expense. GRANTOR reserves the right to improve, occupy c 3 0 z and use this easement for any and all purposes consistent with the easement D n 3 grant with the following exception: GRANTOR will not install, site or 7 encumber easement right of way with any permanent structure or device which will impede the maintenance, repair or replacement of culinary water line, however installation of signs (or billboards) will be allowed. In the event that signs and the waterline are to be located within this easement, it is understood that GRANTEE and GRANTOR will work together to place such features so that both can occupy the space and both parties will be able to access and maintain their facilities. 2. Description of Easement. The easement shall be a 30 foot wide tract of land the western edge of which is described as follows: Beginning at a point which is the Southwest corner of Section 6, T31N, R118W of the 6th P.M., Wyoming and running thence 660.00 feet North 0 °12'E; thence 183 more or less feet North 89 °35'E to the Northwest corner of the GRANTORS property Johnson Easement Page 1 described on the attached Exhibit A, thence south radially along the GRANTORS existing west boundary line a distance of 120 feet. 3. Binding Effect. The terms and conditions of this easement shall be binding upon and inure to the benefit of the heirs, successors and assigns of the parties named in this instrument. My Commission Expires November 11, 2014 My commission expires 11 Itw 1 Residing In: Live` c at l,J Johnson Easement Page 2 Exhibit A: Legal Description of GRANTOR Property All of that portion of the following described parcel which lies East of the East right -of- way line of U.S. Highway 89, said parcel being a part of the S1 /2S1 /2SW1 /4 of Section 6, Township 31 North, Range 118 West of the 6th P.M., Wyoming, to wit: Beginning at a point which is the Southwest corner of said Section 6 and running thence 660.00 feet North 0 °12'E; thence 722.91 feet North 89 °35'E; thence 293.89 feet South 0 °25'E; thence 214.20 feet due West; thence 635.27 feet South 54°06'17" to the point of beginning. The East right -of -way line of U.S. Highway 89 as referred to above is described as, to wit: A line located parallel to and 75 feet East of, when measured radially the following described centerline of said highway right -of -way beginning on the South boundary and ending on the North boundary of said S 1 /2S 1 /2S W 1 /4 of said Section 6; beginning at a point of the South boundary of said S1 /2S1 /2SW1 /4 from which the Southwest corner thereof bears South 89°10'W a distance of 468 feet, more or less, said point of beginning also being located on the spiral arc of a 3 °00' spiral curve to the right, the spiral lengths of which are 450.0 feet, the total length of which is 1,681.1 feet, the total central angle of which is 36 °56', and at which point a line tangent to said curve bears North 37°08.8'W; thence along said spiral arc through a central angle of 6 °40.8' a distance of 403.9 feet; thence along the circular arc of said curve through a central angle of 10 °57' a distance of 365 feet more or less, to a point on the North boundary of said S 1 /2S 1 /2 S W 1 /4.
