ROBERTS CLERK OF DISTRICT COURT 3rd JUDICIAL DISTRICT FANYCMINQ ORDER FOLLOWING MOTION HEARING This matter came before this Court on the Motion of Defendant /Petitioner Patricia Aullman; and a hearing was held on September 19 2013 at 1:00 p.m. in the District Courthouse of the Third Judicial District in Kemmerer, Wyoming. Defendant Patricia Aullman appeared in person and was represented by her attorneys, Elizabeth Greenwood and Travis Bing; Plaintiff Don Aullman appeared pro- se. The Court having heard the testimony of the parties, having reviewed the pleadings, exhibits, and information provided in the file, and the Court being otherwise familiar in the premises IT IS HEREBY ORDERED, ADJUDGED AND DECREED THAT: o z 1. Plaintiff/Husband is FOUND to be in indirect civil contempt of Court for his failure to x 0 G o z abide by the terms and conditions contained in the June 28 2005 Marital Settlement O I, Z Agreement between the parties, as incorporated by the Decree of Divorce filed on July T rn 29 2005. N rn N OWN rn o 2. Plaintiff /Husband is ORDERED to pay Defendant /Wife $600,000.00 in addition to c co w accrued simple interest at a rate of 6% per annum calculated from the date of June 28, n 3 2013 and continuing to accrue until the judgment is satisfied. Judgment is to be paid in either cash or a mixture of real property and cash as approved by the Defendant /Wife. 3. Plaintiff /Respondent, Don Aullman is ORDERED to sign a valid quitclaim deed to the rn Defendant, Patricia L. Aullman conveying a marketable title to the home located at 483 N. Main in Thayne, Wyoming, by no later than September 27 2013. If Plaintiff fails to do so, this Court will order said conveyance to be done directly pursuant to Rule 70 of the Wyoming Rules of Civil Procedure. To the extent that the real property is subject to any attached encumbrances and /or obligations, those encumbrances and /or obligations 1 shall become the responsibility of the grantee, however the fair market value shall reflect and account for any of these encumbrances or obligations. 4. It is hereby ORDERED: if the parties are unable to mutually agree to the fair market value of the above property as per the Marital Settlement Agreement, then a mutually selected, Wyoming certified real estate appraiser shall determine the value of the property at the Plaintiffs cost. The settlement award owing to the Defendant from the Plaintiff shall be set -off by the fair market value of the property as determined above minus any encumbrances. 5. Plaintiff/Respondent, Don Aullman is ENJOINED and restrained from further encumbering any real or personal property titled in his name. 6. Plaintiff /Don Aullman is ORDERED to pay rent to the Defendant at a rate of $1200 per month for the time that he has lived on the property for the period of June 28, 2013 until September 19, 2013. For any period that Plaintiff/Don Aullman remains on the property after September 19, 2013 he shall be liable for fair market rent. 7. Plaintiff /Don Aullman is ORDERED to pay the attorney's fees, costs and expenses incurred by the Defendant in connection with enforcing the terms of the Marital Settlement. This obligation shall be ongoing until the Plaintiff /Husband is in full compliance with the terms of the Marital Settlement and he purges himself of contempt. 8. Plaintiff/Don Aullrnan's indirect civil contempt shall be purged by a showing to this Court that he is in full compliance with this order and the June 28, 2005 Marital Settlement, at which time this Court will enter an appropriate order reflecting such compliance and the purging of the contempt.
